DISGUSTING: Woman Sues Arby’s After Manager Allegedly Spit In Her Food Causing Her To Contract Herpes

An Oklahoma woman has sued Arby’s after allegedly contracting herpes from a sandwich she claims was contaminated by a manager’s spit.

According to the lawsuit the woman discovered there was spit in the sandwich after overhearing the manager of the Arby’s boasting about spitting in it in a FaceTime call.

The woman later tested positive for herpes and her attorney claims the manger had a visible herpes outbreak at the time she allegedly spit in the food.

A woman is suing after she says an Arby’s manager in Broken Bow, Oklahoma, spit in her food and gave her herpes—and her attorney says surveillance footage proves it happened.

Attorney Will Blocker says his client, Jennica Church, stopped at an Arby’s in Broken Bow in March after finishing a long shift at work.

“She swung into Arby’s, was really hungry, asked for a couple of sandwiches,” Blocker said.

Blocker says restaurant manager Amanda Hendricks served Church two hot roast beef sandwiches.

He claims Church ate one, then drove home and shared the other with her father-in-law and mother.

Blocker says Church’s daughter—who was dating Hendricks’ son—later walked in on him talking with Hendricks on FaceTime, where he says Hendricks proudly admitted to spitting in Church’s sandwiches.

“And she got a recording of that,” Blocker said. “Her daughter got a recording of that. And the woman was not scared to say it outright. You can tell your mom I spit in her sandwich.”

Blocker claims Church called the franchisee’s complaint line, where a woman who answered claimed she reviewed surveillance footage and found nothing wrong.

“She said, ‘Oh, yes, yes, yes, the foods are safe,’” Blocker said. “‘We watched the video. There was nothing.’”

Blocker claims Church—who had never shown signs or symptoms before—tested positive for herpes around the same time.

The lawsuit alleges Hendricks knew she had the oral herpes virus—even had visible lesions on her body—but “intentionally and deliberately” spit on Church’s food anyway.

Last week three Wendy’s employees were arrested in a similar incident after serving a customer with food from the trash and then proceeding to spit on it.

Three Wendy’s employees in South Carolina were arrested after allegedly pulling food from the trash and spitting on it before serving it to a customer who had complained about her initial order.

Aaliyah Shuntai Sanders, 23, Trinity Lashell Rice, 19, and Shadela Crystal Holley were all charged with tampering with a human drug product or food item following the incident at a Wendy’s in the city of Union.

Fox Carolinas reported that all three suspects were arrested separately between June 16 and June 22.

The incident occurred on May 31 when a customer ordered from the drive-thru but encountered an issue with her meal. When she requested a refund, staff members took the food back. However, the employees then offered to remake the order, which the customer ultimately accepted before driving away.

While driving, the customer received a phone call from someone at the restaurant who informed her that an employee had pulled her food from a trash can and spat on it.

Upon checking the meal, the woman realized the “new” order was actually the same food from her initial order.

She immediately contacted the police to report the incident. The victim also called the store to speak with the restaurant manager, who confirmed he had spoken with the staff and verified the allegations. The manager noted that all three employees involved had been written up.
