Lawsuit Asserts Blue State Program Excludes Schools With Too Many White Kids


In generations past, school segregation was a tool for leftist racists to oppress Black students and their families.

Today, it appears that the same racist ideology is being weaponized against White students in places like Oregon.

The Daily Caller had this report:

“What stands out most about Oregon’s system of public school funding is the sheer blatancy of the discrimination – explicit racial quotas and race-based bonuses for distributing public funds written into Oregon law and policy. This race-based essentialism has no place in Oregon or elsewhere in the United States,” DNH Chief Medical Officer Dr. Kurt Miceli told the DCNF.

Oregon’s Department of Education awards the Charter School Equity Grant to schools where at least 65% of students are disabled and/or students belong to “[r]acial or ethnic groups that have historically experienced academic disparities,” according to the grant’s text.

This violates the “‘color-blind’ mandate” of both Title VI and the 14th Amendment’s Equal Protection Clause, the complaint alleges.

“…[G]overnments, the [Supreme] Court explained, may not use ‘amorphous concept[s]’ like past ‘societal discrimination’ to justify giving a boost to members of one racial group ‘at the expense of other innocent individuals,’” it states.

The filing also challenges Oregon’s higher education funding formula, which awards additional state funding to public universities based in part on the number of graduates from what the state defines as “underrepresented” racial or ethnic groups.

According to the complaint, the policy effectively provides “bonus” taxpayer dollars for graduates who are not white or Asian.

Defending Education and Do No Harm contend the programs rely on racial classifications that fail strict constitutional scrutiny and improperly tie public funding to race.

“Oregon’s Department and Commission are discriminating on the basis of race in programs or activities that receive federal financial assistance,” the groups wrote.

The organizations are asking federal officials to open a civil rights investigation and require Oregon to end the challenged policies.

Of course, Oregon is hardly alone in promoting the perception of an anti-White bias in education:
