Obama-Era Judge BLOCKS ‘Big Beautiful Bill’ With New Nationwide Injunction


A district court judge just decided to double-down on rebuking President Trump’s ‘Big Beautiful Bill’.

Just a week ago, Boston’s Judge Talwani issued a limited protection against the portion of the bill that effectively defunded Planned Parenthood.

The provision in the bill eliminates federal funding for organizations that also provide abortions.

That ruling last week effected just a handful of facilities.

But today she amplified that decision and — for the moment — ensured that federal funds would continue to flow to Planned Parenthood facilities NATIONWIDE.

Even if they provide abortion services.

Somehow, both houses of Congress and the President of the United States forgot to check with District Judge Indira Talwani before passing the ‘Big Beautiful Bill’.

But, not to worry.  Ever the activist… Talwani caught the slipup herself and corrected it!

The Trump Administration’s Health and Human Services spokesman was quick to speak up and call a red-flag foul on Talwani’s obvious judicial overstep.

But the judge’s history of blocking President Trump’s agenda likely means she doesn’t care.

Today’s ruling massively amplified her shot-across-the-bow from a week ago, as reported by The Hill:

A federal judge in Boston on Monday blocked the Trump administration from cutting funding to all Planned Parenthood affiliates as part of the GOP’s new tax cut and health law.

The ruling by U.S. District Judge Indira Talwani expands on a decision last week, when she issued a preliminary injunction restoring Medicaid funding for only 10 Planned Parenthood affiliates.

Planned Parenthood Federation of America, which advocates for abortion rights and does not provide medical care, sued on behalf of all of its 47 regional affiliates, along with its Utah and Massachusetts chapters.

The lawsuit contests a provision in the new law that imposes a one-year ban on state Medicaid payments to health care nonprofits that also offer abortions and received more than $800,000 in federal funding in 2023.

Talwani’s ruling last week was narrow. The injunction applied only to affiliates in states where abortion is illegal, and to ones that did not exceed the $800,000 revenue threshold.

“We strongly disagree with the court’s decision. States should not be forced to fund organizations that have chosen political advocacy over patient care. This ruling undermines state flexibility and disregards longstanding concerns about accountability,” Health and Human Services spokesperson Andrew Nixon said in a statement to The Hill.

Senator Mike Lee, as he is prone to do, seemed to capture to essence of the moment:

The primary argument put forward by the judge in her newest ruling revolves around the idea that cutting funding to abortion providers (get this):

Might somehow limit abortion providers… from providing abortions.

And if that seems to have been the entire POINT behind that portion of the bill, and the reason President Trump SUPPORTED it’s inclusion in the bill — you would be right!

As usual, a judge with a social agenda and an anti-Trump axe to grind has inserted herself in the mix; and unconstitutionally so.

She included in her comments on today’s ruling that she deemed that the portion of the ‘Big Beautiful Bill’ in question was simply a means of “punishing” Planned Parenthood and it’s members, according to CNN:

“Patients are likely to suffer adverse health consequences where care is disrupted or unavailable. In particular, restricting Members’ ability to provide healthcare services threatens an increase in unintended pregnancies and attendant complications because of reduced access to effective contraceptives, and an increase in undiagnosed and untreated STIs,” Talwani, an appointee of former President Barack Obama, wrote in the 58-page ruling.

The measure, part of Trump’s domestic policy bill that was signed into law July 4, bars Medicaid users from coverage with a health care provider that also provides abortion services.

The judge said that the plaintiffs in the case – the Planned Parenthood Federation of America, along with Planned Parenthood League of Massachusetts and Planned Parenthood Association of Utah – were likely to succeed on their claim that the law had singled out the health care provider for adverse treatment.

“The legislative history and context confirm that the law’s purpose is to single out Planned Parenthood Federation and its Members for punishment,” Talwani wrote, going on to note that comments by individual lawmakers “support the conclusion that Congress’s intent was punitive.”

The ‘Big Beautiful Bill’ didn’t even expressly mention Planned Parenthood, just to be clear.

And there is a big difference between ‘punishment’ and ‘defunding’.

Punishment would have put abortion-providers behind BARS.

The simple act of eliminating federal funding to facilities that provide a service (I’m putting that mildly…) which is NO LONGER deemed a ‘right’ by law… is certainly not punishment.

If anything, it is rather lenient.

At any rate, ANOTHER judge thinks that Judge Taliwani’s ruling is going to be overturned.

Judge Napolitano made those comments even before her latest wide-reaching judgement, after last week’s more limited ruling from her high-and-mighty bench:

To be sure, there are two sagas that have not yet played themselves out.

One is the saga of overreaching judicial activists; the other being the furious attack at every step of the way of MAKING AMERICA GREAT AGAIN.

Make no mistake — anything that pushes back against killing babies was SURE to draw fire from those hellbent on continuing that practice wholesale.  (Emphasis on SALE.)

But the added fact that it was President Trump’s landmark legislation that severed those funds from being used in slaughtering America’s unborn… is guaranteed to keep that fight front and center without any end in sight.
