UPDATE: FBI Arrests Rioter Who Made Death Threats Against ICE Agent & His Family

On Wednesday night, a leftist rioter was filmed outside the Delaney Hall ICE detention center in Newark, NJ threatening to kill an ICE agent and his family.

The clip went viral, and Acting AG Todd Blanche responded by vowing to find and arrest this agitator over his sick threats.

If you missed it, here’s our original report on that:

Now, Todd Blanche has fulfilled his promise!

The rioter who made the deranged threats has been identified as 27-year-old Nicholas Scelfo from Brooklyn, NY.

Tonight, the FBI raided his home and arrested him.

Nick Sortor, who captured the original video, provided us with this update on the situation:

BREAKING: FBI has just RAIDED and ARRESTED the man who I caught on video threatening the lives of an ICE agent and his family outside ICE Newark

Nicholas Scelfo is facing FEDERAL FELONIES

THIS IS HOW IT’S DONE! 🔥

THANK YOU to @FBIDirectorKash

ACTING AG BLANCHE: “FAFO.”

Acting AG Todd Blanche confirmed on X:

DHS Secretary Markwayne Mullin also released a statement:

Thank you to the @FBI for arresting a rioter who threatened to kill an @ICEgov
law enforcement officer and his family outside Delaney Hall.

Our officers are facing an 8,000% increase in death threats against them as they put their lives on the line to arrest the worst of the worst.

@POTUS and I will always stand with our law enforcement.

Apparently, Scelfo was also a participant in the 2020 BLM riots and this year’s ‘No Kings’ protests.

Independent journalist Andy Ngo shared some more photos of him:

FAFO.

We don’t know exactly what charges Scelfo is facing, just yet.

But, Grok estimates that he could be sentenced to several years behind bars:

Nicholas Scelfo faces federal felony charges for threatening an ICE agent and the agent’s family, as shown in the video outside the ICE facility in Newark.
Likely Relevant Federal Statutes and Penalties

This type of conduct commonly falls under statutes like:

  • 18 U.S.C. § 115 (Threats against a federal official or their family): Up to 10 years in prison.
  • 18 U.S.C. § 111 (Assaulting, resisting, or impeding federal officers):
    • Basic level: Up to 1 year.
    • Felony level (with intimidation or aggravating factors): Up to 8 years.
    • If a deadly weapon or bodily injury is involved: Up to 20 years.

The video evidence of him shouting explicit death threats against the agent and family makes a strong case for felony charges.

Realistic Jail Time Outlook

  • Maximum possible: 10–20 years, depending on the exact charges and any enhancements.
  • Likely sentence if convicted: For a first-time offender with clear video evidence but no actual violence carried out, federal cases often result in 2–8 years (or more with aggravating factors), plus supervised release and a permanent felony record. Many cases end in plea deals that reduce the time served.

Federal prosecutions in these cases (especially with strong video) tend to be taken seriously, but the final sentence will depend on the full indictment, his criminal history, any plea agreement, and the judge.

Let this serve as a warning to all the other radical leftists out there who are thinking about threatening an ICE agent.

Regardless of politics, it is never okay to threaten to kill a federal officer, and it could end with you going to jail for quite awhile.
