Jury Reaches Verdict In Case of Man Who Threw Sandwich At Federal Agent In D.C.


I wonder if the verdict would be the same if the man was a Trump supporter.

More than likely not!

The former DOJ employee who threw a sandwich at a Federal agent has been found not guilty in a Washington D.C. Court.

Jurors in Washington D.C. found Sean Charles Dunn, the former DOJ employee who threw a sandwich at a Border Patrol agent during a protest in August, not guilty.

The Associated Press broke the ruling:

A former Justice Department employee who threw a sandwich at a federal agent during President Donald Trump’s law enforcement surge in Washington was found not guilty of assault on Thursday in the latest legal rebuke of the federal intervention.

A viral video of the sandwich tossing made Sean Charles Dunn a symbol of resistance to Trump’s deployment of federal agents to combat crime in the nation’s capital.

His misdemeanor acquittal is another setback for prosecutors, who have faced a backlash for their aggressive charging tactics during the law enforcement surge. The Justice Department had initially sought a felony assault indictment against Dunn, but in a highly unusual move, the grand jury declined to sign off on the felony charge. The office of U.S. Attorney Jeanine Pirro then charged Dunn with a misdemeanor.

There was no dispute over whether Dunn threw the sandwich at a U.S. Customs and Border Protection agent on the night of Aug. 10. But his lawyers argued it was a “harmless gesture” during an act of protest protected by the First Amendment.

CNBC reported on how Dunn’s attorney defended him:

Dunn’s attorney, Sabrina Shroff, during closing arguments on Wednesday said that the confrontation was the result of his “strongly held feelings” about immigration enforcement, NBC News reported.

Shroff also told jurors that “you are the ones impacted by the executive orders” issued by Trump which put federal law enforcement officers on the streets of D.C., NBC reported.

“You are the ones impacted by the executive orders … there was and remains a huge law enforcement presence in the district,′ Shroff said.

The defense attorney also argued that the, “The sandwich did not impede Officer Lairmore’s duties that night …. A footlong from Subway could not and certainly did not inflict bodily harm,” NBC reported.

Shroff also noted that Lairmore had received two “gag gifts” from co-workers, a plush sandwich and a patch featuring a cartoon of Dunn throwing the sandwich with the words “Felony Footlong,′ according to the outlet.

“If someone assaulted you, if someone offended you, would you keep a memento of their assault? Would you stick it on your daily lunchbox and carry it with you day in and day out?” she asked.
