Texas Lawmaker Pushes to Make Birth Tourism a FELONY After SCOTUS Ruling


Following the disastrous Supreme Court ruling upholding birthright citizenship, a Texas lawmaker is fighting back.

Texas State Rep. Brian Harrison wants to make birth tourism a felony in the state.

He is calling for a Special Session of the Legislature to be held in order to pass such a measure.

Rep. Harrison announced on X:

I’m demanding a special session to MAKE IT A FELONY TO ENGAGE IN BIRTH TOURISM IN TEXAS, stop issuing birth certificates to non-citizens, and more after SCOTUS’ absurd birthright citizenship ruling!

Texans deserve action, not just rhetoric, from their state leaders. Texas must start acting like the sovereign state it is and stop taking it on the chin when actions from DC threaten to destroy the very fabric of our republic. Texas must not simply act like a powerless bystander but take bold and decisive action to protect liberty for future generations.

I am publicly demanding an immediate special session to combat the harms from mass birth tourism, pressure the federal government to fix birth tourism, and to protect the value of citizenship that countless paid the ultimate price for. I hope every elected Republican in Texas joins my call for immediate action. Delay is unacceptable for a state like Texas!

Texas should pass the following IMMEDIATELY in a special session:

· Make it a felony to operate or participate in birth tourism within our borders

· Expand criminal offense of illegal entry to include entering for purposes of birth tourism

· Stop issuing birth certificates to children of non-citizens

· Give the Attorney General authority to investigate and prosecute birth tourism

· Ban preplanned adoption agreements and gestational surrogacy contracts if any party involved is a citizen or resident of a country of concern (as Florida has already done)

· Pass a resolution formally condemning the Supreme Court’s decision in Trump v. Barbara

· Pass a resolution formally demanding the U.S. Congress take any and all necessary actions to fix birthright citizenship

The Daily Signal reported further on Rep. Harrison’s push:

Last week, the U.S. Supreme Court ruled that birthright citizenship may remain in place, with Chief Justice John Roberts writing that the 14th Amendment guarantees citizenship to anyone born on U.S. soil, regardless of their parents’ immigration status.

The following day, Republican state Rep. Brian Harrison sent a letter urging the Texas Legislature to convene an immediate special session to protect Texans from “birth tourism.”

In his letter, Harrison called for legislation making it a felony to operate or participate in birth tourism within Texas, expanding the criminal offense of illegal entry to include entering the state for the purpose of birth tourism, and granting the Texas attorney general authority to investigate and prosecute birth tourism cases.

Harrison is also urging lawmakers to adopt a resolution formally condemning the U.S. Supreme Court’s decision and another resolution calling on Congress to take action on birthright citizenship.

Rep. Harrison recently appeared on Fox News, where he discussed the matter with host Kayleigh McEnany.

“I’m calling for an immediate special session. I want Governor Abbott to call us back to the Capitol right now so that we can make birth tourism a state level felony — that is absolutely an option that’s available to us under our state and federal constitutions.”

“It’s Texas. We get to decide what’s legal and what’s not legal to operate as businesses in our state!”

“And number two, something that doesn’t even require a special session. We need the governor and his political appointee at HHS in Texas to immediately stop issuing birth certificates to illegal aliens and noncitizens.”

“As far as I’m concerned after that ruling on birthright citizenship — the fact that the state of Texas is still giving out birth certificates, not just giving them out, by the way, advertising them on our Texas government taxpayer funded website advertising the types of foreign documents that we will accept to get a birth certificate!”

“If you can just get here for long enough to have your baby born here and then lead to where her country you came from, that is not only NOT fighting birth tourism. That is actually incentivizing birth tourism and that is a betrayal of the 30 million Texans who call this state home.”

Harrison’s push comes as shocking reports have come to light claiming that hospitals are blatantly advertising services at the border for foreign nationals who want to have their babies in the United States.

Recently, Texas AG Ken Paxton also exposed homes in his state that appear to be a cover for birthright citizenship farms.

These houses are full of rows upon rows of bassinets for foreign women giving birth in our country to secure citizenship for their babies.

In this Fox News clip, Rep. Harrison dove deeper into the problem:

These are appearing in buildings that just look like normal family homes!

How could the Supreme Court look at this and think, "YES, THAT'S WHAT OUR FOUNDERS WANTED?!"

Reverse it now. Time for states to take action and make new laws!

President Trump is asking the Supreme Court to re-consider the birthright citizenship case, and state lawmakers like Rep. Brian Harrison are coming up with work-around solutions.

At this time, it's unclear if either of these efforts to fix the growing issue of birth tourism in our country will go anywhere.

But, this much is obvious: something has to change!
