Gavin Newsom Suffers MAJOR Defeat in Appeals Court

In a huge defeat for Gov. Gavin Newsom, an appeals court just blocked California’s anti-ICE mask ban from going into effect.

The legislation, which was signed by Newsom last year, would prevent federal agents from wearing masks and require them to essentially doxx themselves by forcing them to display visible identification.

But now, the 9th Circuit Court of Appeals has struck it down.

After Newson signed the law in September, the Trump administration filed an appeal arguing that the piece of legislation was unconstitutional because it violates the Supremacy Clause.

In other words, under the U.S. Constitution, a state cannot regulate the federal government.

CBS News has more details on the ruling:

A three-judge panel of the 9th U.S. Circuit Court of Appeals issued an injunction pending appeal Wednesday. It had already granted a temporary administrative injunction to block the implementation of the law.

“We conclude that [section] 10 of the No Vigilantes Act attempts to directly regulate the United States in its performance of governmental functions,” the ruling reads. “The Supremacy Clause forbids the State from enforcing such legislation. The United States is therefore likely to succeed on the merits of its Supremacy Clause claim, and the other preliminary injunction factors also weigh in its favor. Thus, we grant the motion for an injunction pending appeal.”

At a time when violence against ICE agents is up by an astonishing 1,300%, this law would have put our officers in significant danger.

After all, the only reason ICE has to wear masks in the first place is to protect themselves from left-wing attacks!
