BREAKING: Federal Appeals Court Authorizes President Trump to Deploy Troops to Portland

This just in: a federal appeals court just granted President Trump a gigantic victory!

After a lengthy court battle, the 9th Circuit Court of Appeals has just ruled to allow President Trump to deploy the Oregon National Guard to Portland.

The final decision was 2-1 on the three-judge panel.

The only judge who dissented was a Clinton appointee.

CNBC reported:

A federal appeals court on Monday said that President Donald Trump could deploy National Guard troops to the streets of Portland, Oregon.

The 2-1 ruling by a three-judge panel on the 9th Circuit U.S. Courts of Appeals stayed a temporary restraining order issued by a federal district court judge on Oct. 4 enjoining Trump’s order to federalize 200 members of the Oregon National Guard to protect an Immigration and Customs Enforcement facility in Portland.

“After considering the record at this preliminary stage, we conclude that it is likely that the President lawfully exercised his statutory authority under” a law “which authorizes the federalization of the National Guard when ‘the President is unable with the regular forces to execute the laws of the United States,’ ” the majority of the panel said in its decision Monday.

Both of the judges in the majority, Ryan Nelson and Bridget Bade, were appointed to the 9th Circuit by Trump.

The dissenting judge, Susan Graber, who was appointed by former President Bill Clinton, in a written dissent, urged other judges on the 9th Circuit to “act swiftly to vacate the majority’s order because the illegal deployment of troops under false pretenses can occur.”

This ruling is a reversal of Judge Immergut’s prior ban on President Trump deploying the National Guard from any state to Portland.

After a federal judge in Oregon temporarily blocked Trump’s attempt to deploy troops to Portland earlier this month, the 9th U.S. Circuit Court of Appeals agreed to hear the Trump administration’s appeal.

The lower court judge had described Trump’s action in her emergency order as “untethered to reality,” and one that she said risks “blurring the line between civil and military federal power — to the detriment of this nation.”

The appeals court quickly stayed the lower court’s order pending review.

The ruling comes as Trump has sought to deploy hundreds of National Guard troops to Democratic-led cities despite stated opposition from local and state leaders. Senior administration officials have argued that the deployment is a necessary step to crack down on what they say is an uptick in violent crime and protect against threats from protesters, including anti-ICE demonstrations in many downtown areas.
