JUDICIAL COUP: Obama Judge Defies SCOTUS to Shield Somali Migrants


The rogue judicial branch strikes again.

On Friday, a left-wing activist judge blocked the Trump administration from ending Temporary Protected Status (TPS) for Somali migrants.

Specifically, she issued an administrative stay preventing the termination of TPS while further litigation continues.

In doing so, Obama-appointed Judge Allison Burroughs blatantly defied a Supreme Court decision that ruled lower courts cannot override the Trump administration when it comes to TPS.

The judicial coup must be stopped at all costs!

Last month, on June 25th in Mullin v. Doe, the Supreme Court made it very clear that judges do not have the authority to overrule the DHS on TPS.

In the 6-3 decision, SCOTUS ruled in the Trump administration’s favor on a challenge to the termination of TPS for Haiti and Syria.

Grok explained the implications for judges ruling on TPS:

  • District and circuit judges cannot review or block TPS terminations on statutory/APA/procedural grounds. The Supreme Court made clear that Congress stripped courts of that authority. Any injunction or stay based solely on those claims is inconsistent with Mullin.
  • Constitutional claims (equal protection, due process, etc.) can still be litigated, but success is difficult. Courts must apply the high bar illustrated in Mullin (plaintiffs must show race or another protected characteristic was a motivating factor, overcoming race-neutral explanations).
  • Lower courts are expected to align existing stays/injunctions with Mullin. The government has moved to lift stays in other TPS cases (Venezuela, Ethiopia, Burma/Myanmar, South Sudan, Somalia, Yemen, etc.), and some courts have already done so or been directed by appellate courts to reconsider in light of Mullin. USCIS guidance repeatedly notes that extensions of EADs under court orders are “limited relief until the lower courts align with” Mullin.
  • Practical effect: It significantly narrows the ability of individual district judges to halt nationwide (or country-specific) TPS terminations, shifting power back to the DHS Secretary’s discretion as Congress structured it. Appeals and emergency applications to higher courts (including the Supreme Court) remain available if a lower court issues relief that conflicts with the ruling.

Judge Burroughs is choosing to ignore the Supreme Court ruling in order to protect Somalian migrants.

In other words, this unelected judge believes she can act as king and do whatever she wants.

Rogue judges are completely out of hand. It’s ridiculous that these judges are continually allowed to impede the Trump agenda.

Their power trip must be stopped!
