Former FBI Director James Comey is expected to be indicted on criminal charges in the coming days in federal court in Virginia, MSNBC reported Wednesday.
The expected indictment comes on the heels of a top prosecutor resigning under pressure after opposing the filing of charges against Comey, who for years has been a target of President Donald Trump’s ire.
MSNBC reporter Ken Dilanian, in a post on X, said Comey is expected to be indicted in the Eastern District of Virginia, according to three people familiar with the matter.
“The full extent of the charges being prepared against Comey is unclear, but the sources believe that at least one element of the indictment — if it goes forward — will accuse him of lying to Congress during his testimony on September 30, 2020 about whether he authorized a leak of information,” Dilanian tweeted.
The reporter noted that the five-year statute of limitations on that charge would lapse next Tuesday.

Federal prosecutors are nearing a decision to bring possible perjury charges against former FBI Director James Comey, with a legal deadline expiring on Tuesday, according to people familiar with the investigation.
The probe, run by federal prosecutors at the US Attorney’s Office for Virginia’s eastern district, is examining whether Comey made false statements during his September, 30, 2020, testimony to Congress on his handling of the investigation into Russian meddling in the 2016 US presidential election, people familiar with the matter said. Prosecutors, under criminal law, generally would only have five years to the day to bring a charge.
If a federal grand jury were to approve the case by next week, it would mark one of the highest-profile indictments of a political figure during President Donald Trump’s second term in office – and against one of the longtime figures whom Trump and his political allies detest the most from what they call the “deep state” of the federal government.
ADVERTISEMENTComey hasn’t been charged with a crime and has maintained in testimony that he’s been truthful under oath. An attorney representing Comey in the matter hasn’t responded to requests for comment from CNN on Thursday.
If indicted, it will be the first time a former FBI director has been indicted in U.S. history.
