BREAKING: Federal Judges Order RELEASE Of Kilmar Abrego Garcia, BLOCK ICE From Arresting Him Again


Two leftist rogue judges are doubling down on efforts to free and protect accused MS-13 gang member Kilmar Abrego Garcia — a.k.a. “Maryland Man.”

Today, in back-to-back rulings, two judges — both Obama appointees — ruled to release Garcia from custody and block ICE from detaining him again, upon his release.

The first judge, Waverly D. Crenshaw, ordered Garcia to be released from jail on bail.

Crenshaw, an Obama appointee, upheld a magistrate judge’s conclusion that Abrego should not be detained pending trial and must be released on bail. The magistrate will set Abrego’s release conditions.

Crenshaw also said prosecutors had made a sufficient showing that Abrego’s alleged smuggling activity likely involved “a minor victim.” That is enough to entitle the government to seek pretrial detention, but Crenshaw concluded that detention wasn’t appropriate because — with proper release conditions — Abrego is unlikely to flee or pose a danger to the community.

Crenshaw said prosecutors’ claims that Abrego might flee because he could fear being picked up again by Immigration and Customs Enforcement amounted to “pure speculation.”

“It is not difficult to see why one might seek to avoid ICE after experiencing what Abrego did in recent months,” the judge wrote, pointing to the Supreme Court’s description of Abrego’s saga.

“Still, the irony of the Government making this argument when it (albeit a different department in the Executive Branch) created these circumstances is not lost on this Court.”

Almost simultaneously, a separate judge, Paula Xinis, ruled that ICE cannot arrest Garcia again after he is released.

Immigration authorities had previously promised to detain him in Maryland if he is released from the jail he is currently being held at in Tennessee.

BREAKING: Maryland federal judge Paula Xinis has just issued an order that will block ICE from arresting “Maryland man” Kilmar Abrego Garcia upon his release on bail in Tennessee for his federal human trafficking charges. Judge Xinis is also ordering a 72 hour pause on any effort to deport him to a third party country without “sufficient notice” and “due process”.

Abrego Garcia, a Salvadoran illegal alien alleged MS-13 gang member and alleged repeat wife beater, is facing federal human smuggling charges in Tennessee, and a judge there is deciding whether to release him pending trial. The government had indicated it would take him into ICE custody in Tennessee if he was released pending his federal case.

Judge Xinis has now blocked the Trump administration from taking him into ICE custody upon his release.

However, there is a silver lining.

Later on, a magistrate judge put a 30-day pause on both of these orders from going into effect.

So, Garcia will not be released for at least 30 days, giving the Trump administration plenty of time to appeal.

A magistrate judge on Wednesday paused Kilmar Abrego Garcia’s release from federal custody, shortly after a separate judge ruled that the man, who was mistakenly deported in March to El Salvador, should be released while he awaits trial on human smuggling charges.

Magistrate Judge Barbara Holmes in the Middle District of Tennessee ordered Abrego’s release from federal custody paused for 30 days, or until further court order.

“Abrego shall therefore remain in the custody of the United States Marshal pending further order,” she wrote.

The pause, which was asked for by both parties, will allow the government the opportunity to appeal, and Abrego’s legal team the chance to seek further relief.

It followed back-to-back rulings from U.S. District Judge Waverly Crenshaw in Nashville, Tennessee, and Judge Paula Xinis in Maryland that ordered Abrego’s release and blocked his detention by immigration authorities in Tennessee.

Crenshaw’s order denied the Trump administration’s motion to block Abrego’s release, writing that the government “fails to provide any evidence that there is something in Abrego’s history, or his exhibited characteristics, that warrants detention.”
