In another victory for President Trump, a federal judge has just approved his invocation of the Alien Enemies Act to deport illegal gang members.
U.S. District Judge Stephanie L. Haines, who was appointed by President Trump, issues the ruling.

BREAKING: Federal Judge Stephanie Haines just ruled that President Trump’s invocation of the Alien Enemies Act to deport gang members satisfies the law.
“Second, the Court finds that the Proclamation and the documents it references support the finding that TdA is committing a “predatory incursion” as that term is defined in the AEA. Indeed, an FTO is a cohesive group of individuals united by a common goal of causing significant disruption to the common safety of the public…”
“Therefore, for all of the foregoing reasons, the Court finds that the Proclamation meets the definition of ‘predatory incursion’ under the AEA, and the Court finds that A.S.R. has not shown a likelihood of success on the merits on this issue.”
Good to see not all our judges have sold their souls to the devil.
This is a huge win!
However, the ruling only applies to Judge Haine’s district in Western Pennsylvania.
Still, it creates a path for the Trump administration to take in order to move forward with deportations under the Alien Enemies Act.
The New York Times said:
A federal judge on Tuesday opened a path for the Trump administration to move forward with deporting a Venezuelan man under the Alien Enemies Act, a wartime law, but ruled that it must first give him notice in his native language, 21 days to object and an “opportunity to be heard” in court.

Haines of the Western District of Pennsylvania, could provide a legal opening for the administration to restart deportations under the Alien Enemies Act of Venezuelans whom it considers to be members of Tren de Aragua, a gang that the White House has designated as a terrorist organization. It applies only within Judge Haines’s district, a portion of Pennsylvania that includes Pittsburgh and the Moshannon Valley Processing Center, a privately run immigration detention facility near Philipsburg.
The decision by Judge Haines, who was nominated by President Trump during his first term, cut against recent rulings by three other federal judges — in Texas, Colorado and New York — all of whom had determined that the administration was using the Alien Enemies Act unlawfully.
The Washington Post added:
Judges in Texas, Colorado and New York separately have issued orders blocking Alien Enemies Act deportations in their jurisdictions, finding that the law was meant to deter wars or “predatory incursions,” not to target undocumented immigrants — even those accused of memberships in gangs that Trump has declared foreign terror organizations.
Haines disagreed, writing that the Alien Enemies Act “does not require an ‘invasion or predatory incursion’ to be ‘perpetrated, attempted or threatened against the territory of the United States by the military of any foreign nation or government.’”
“The proclamation and the declarations that respondents have submitted to this Court indicate that there is a factual basis for President Trump’s conclusions in the Proclamation,” Haines wrote. That proclamation references the secretary of state’s designation of Tren de Aragua as a foreign terrorist organization, which Haines said “heavily supports the conclusions” that the gang is a “cohesive group united by a common goal of causing significant disruption to the public safety of the United States.”
