BREAKING: Judge Dismisses TWO CHARGES in Fani Willis Case Against President Trump!


There is BREAKING NEWS in the Georgia election interference case against President Trump today — a judge dismissed two of the criminal counts against Trump and his allies!

THIS IS A HUGE WIN!

According to Fox News, here’s what went down today in the Georgia courtroom:

A judge dismissed two criminal counts in the Georgia 2020 election interference case against former President Donald Trump and one other count against allies of the former president.

Fulton County Judge Scott McAfee ruled that Georgia prosecutors had no authority to bring the charges, which related to alleged filing of false documents in federal court.

Fulton County District Attorney Fani Willis had charged Trump related to alleged 2020 election interference. Trump pleaded not guilty to all counts.

Earlier this year, the judge dismissed six of the charges against Trump, saying Willis failed to allege sufficient detail.

Although this is a huge win on the heels of the six charges thrown out earlier this year, there was no reversal of an earlier decision to hear President Trump’s argument to have Willis DISQUALIFIED on December 5th of this year — a full month after the election.

President Trump’s attorney, Steve Sadow, responded on social media with this statement today:

It still amazes me how a decision to disqualify Fani Willis wasn’t immediately handed down when President Trump’s legal team first brought the alleged misconduct of the Fulton County prosecutor to light earlier this year.  Watch this clip if you need a quick reminder of that scandal surrounding Fani Willis and this entire case:

The Washington Post has the details on how that situation may play in to today’s decision to throw out three of the charges:

The rulings come at a time when the fate of the Georgia case is in question. The case became mired in controversy earlier this year, when Trump and other defendants accused Willis and the lead prosecutor on the case of misconduct related to their romantic relationship. McAfee declined to remove Willis or her office from the case, a decision that the defendants have appealed. The entire case has been essentially frozen since June.

In Thursday’s ruling, McAfee dismissed the three charges under the supremacy clause of the U.S. Constitution, which prohibits state prosecutions of activities that fall under federal jurisdiction.

McAfee said his Thursday decision has nothing to do with the Supreme Court’s decision related to Trump’s federal election interference case in Washington, which granted him partial immunity for actions taken in his official capacity as president. But the judge appeared to leave the door open for immunity issues in the Georgia case, saying they “have not been fully briefed or argued by the parties.”

I find it highly likely that as things shake out, we will ultimately see Fani Willis disqualified altogether because of the alleged misconduct, or else we’ll simply see a broad application of the Supreme Court ruling involving Presidential immunity.

The problem, as usual, is in the meantime these things can be used as fodder in the press to influence voters leading up to the election.

Here’s a quick excerpt from the Washington Post with the specifics of the dismissed charges:

In Thursday’s ruling, McAfee dismissed the three charges under the supremacy clause of the U.S. Constitution, which prohibits state prosecutions of activities that fall under federal jurisdiction.

“The Supremacy Clause declares that state law must yield to federal law when the two conflict,” McAfee wrote.

The charges in question — filing false documents, attempting to file false documents and criminally conspiring to file false documents — primarily relate to the meeting of 16 Trump electors on Dec. 14, 2020, to cast electoral votes for the incumbent president even though he lost the state. The electors signed certificates that were mailed to the National Archives, Congress and federal court, actions that Willis said amounted to forgery.

We’ll bring you more as it becomes available — you never know when another charge might be thrown out in this case!
