SHOCK RULING: Judge McAfee Issues Bizarre “Split Baby” Ruling, Legal Experts Baffled


Well folks, the Ruling is in from Judge McAfee and it’s stunningly bad.

That’s not just my opinion, that’s just about every legal expert I’ve seen this morning reacting to it.

I know this case can be a bit confusing with all it’s twists and turns so let me try and give you a quick summary of where we’re at, how we got here, and then I’ll explain Judge McAfee’s completely ineffective “split the baby” Ruling from this morning.

So it all starts with DA Fani Willis who campaigned on a platform that she would “get Trump”.

She gets elected and brings a 41-count indictment against Trump.

Recently, 6 of those counts have been dismissed by the Judge.

Here’s a nice summary from my friends over at The Gateway Pundit:

A Fulton County grand jury returned a 41-count indictment which included RICO and conspiracy charges against Trump.

On Wednesday Judge McAfee quashed 6 counts in Fani Willis’ indictment – including 3 counts against President Trump.

According to the ruling:

  • Count Two alleges that multiple Defendants solicited elected members of the Georgia Senate to violate their oaths of office on December 3, 2020, by requesting or importuning them to unlawfully appoint presidential electors;
  • Count Five alleges that Defendant Trump solicited the Speaker of the Georgia House of Representatives to violate his oath of office on December 7, 2020, by requesting or importuning him to call a special session to unlawfully appoint presidential electors;
  • Count Six alleges that Defendants Smith and Giuliani solicited members of the Georgia House of Representatives to violate their oaths of office on December 10, 2020, by requesting or importuning them to unlawfully appoint presidential electors;
  • Count 23 alleges that multiple Defendantssolicited elected members of the Georgia Senate to violate their oaths of office on December 30, 2020, by requesting or importuning them to unlawfully appoint presidential electors;
  • Count 28 alleges that Defendants Trump and Meadows solicited the Georgia Secretary of State to violate his oath of office on January 2, 2021, by requesting or importuning him to unlawfully influence the certified election returns; and
  • Count 38 alleges that Defendant Trump solicited the Georgia Secretary of State to violate his oath of office on September 17, 2021, by requesting or importuning him to unlawfully decertify the election.

In the midst of all of that, a “case within a case” developed where the investigation was turned on Fani herself for “improper conduct” (putting it mildly) including but not limited to hiring her boyfriend to work the case, overpaying him by a large amount, not disclosing any of this, and then lying about it after the fact.

We had a mini trial on those issues and the Ruling from the Judge out this morning is the resolution of that mini case.

So you essentially have Fani and her boyfriend Nathan Wade doing all the things I described above and most legal experts seem to agree that was proven beyond any reasonable doubt in the case.

You would expect, then, that the Judge would issue a Ruling against both of them, and yet he didn’t do that.

No, he basically said one of them must go.

Say WHAT now?

So he basically finds that bad stuff did indeed happen, but only one of them will pay a price — and they even get to pick which one it will be!

This is an insanely stupid ruling, and that’s not just my opinion that’s the opinion of just about every legal expert I’ve seen today.

I love how Jonathan Turley put it on Fox News:  “It’s like finding two people in a bank vault and taking only ONE off to jail.”

Judge Napolitano told Newsmax it was “misbehavior, horrible judgment and perjury!”

That’s another common thread I’ve seen from the legal experts.

They all seem to think it was clear beyond any reasonable doubt that Fani committed perjury.

So why does she get to keep her job….or even her law license?

Isn’t lying to the Court under oath as an officer of the court one of the most basic grounds for having your law license revoked?

Then we go to Alan Dershowitz who says the evidence is “overwhelming” to not only remove Fani from this case but “criminally prosecute” her!

So is this Judge just not that bright?

Compromised?

Being blackmailed?

Bribed?

A willing participant in the “Get Trump” effort?

Or something else?

I can’t figure it out, but I know that his ruling makes zero sense to me.

NATIONAL POLL: Should Fani Willis Be Disbarred?

Here are more details from NBC News on their coverage of the Ruling:

A Georgia judge ruled Friday that Fulton County District Attorney Fani Willis should not be disqualified from prosecuting the racketeering case against former President Donald Trump and several co-defendants — with one major condition.

Fulton County Superior Court Judge Scott McAfee found the “appearance of impropriety” brought about by Willis’ romantic relationship with special prosecutor Nathan Wade should result in either Willis and her office leaving the case — or just Wade, whom she’d appointed to head the case.

The choice is likely to be an easy one: If Willis were to remove herself, the case would come to a halt, but having Wade leave will ensure the case continues without further delay.

The judge said the prosecution “cannot proceed” until Willis makes a decision.

Trump attorney Steve Sadow said in a statement that, “While respecting the Court’s decision, we believe that the Court did not afford appropriate significance to the prosecutorial misconduct of Willis and Wade.”

“We will use all legal options available as we continue to fight to end this case, which should never have been brought in the first place,” he added.

Willis’s office did not immediately comment on the ruling.
