LEGAL WIN: Trump Declared Innocent In Death of Jan. 6 Officer Brian Sicknick…Who Died Of Stroke

A federal judge has just dismissed a bogus wrongful death claim against President Trump as part of a lawsuit made in connection with the death of police officer Brian Sicknick.

Officer Sicknick passed away the day after the January 6, 2021 Capitol riot…from a stroke.

Originally, mainstream media reported that Officer Sicknick died from injuries after being assaulted at the Capitol by two men: Julian Elie Khater, 32, of Pennsylvania, and George Pierre Tanios, 39 of Morgantown.

They pushed the false narrative that Sicknick had been hit in the head with a fire extinguisher and later succumbed to injuries for MONTHS, even though an autopsy showed that he died of natural causes resulting from multiple strokes.

Here’s what The Washington Post reported about Sicknick’s actual cause of death:

Capitol Police officer Brian D. Sicknick suffered two strokes and died of natural causes a day after he confronted rioters at the Jan. 6 insurrection, the District’s chief medical examiner has ruled. The ruling, released Monday, likely will make it difficult for prosecutors to pursue homicide charges in the officer’s death. Two men are accused of assaulting Sicknick by spraying a powerful chemical irritant at him during the siege.

In an interview with The Washington Post, Francisco J. Diaz, the medical examiner, said the autopsy found no evidence the 42-year-old officer suffered an allergic reaction to chemical irritants, which Diaz said would have caused Sicknick’s throat to quickly seize. Diaz also said there was no evidence of internal or external injuries. The medical examiner noted Sicknick was among the officers who engaged the Capitol mob and said ‘all that transpired played a role in his condition.’

Along with Trump, the men accused of assaulting Sicknick – Khater and Tanios – were arrested and faced a $30 million lawsuit, which was filed by Officer Sicknick’s ex-girlfriend, Sandra Garza.

Khater and Tanios’ lives were turned upside down by the media’s depiction of them and Garza’s lawsuit.

The credibility of Officer Sicknick’s ex-girlfriend has also been called into question, since they had been broken up for 6 months prior to his death.

Yet, she has posthumously framed herself as his partner, and occasionally, fiancee or widow…

On Tuesday, U.S. District Court Judge Amit Mehta issued a split ruling, throwing out the wrongful death and negligence civil counts made by Garza.

Sandra Garza will not be permitted to seek personal damages for her claims, since Judge Mehta refuses to recognize that she was Officer Sicknick’s “partner.”

However, the case is still moving forward on other counts, including allegations of conspiracy on the part of Trump and these two men to “violate civil rights.”

NBC News has more details on the case and the judge’s ruling:

A federal judge in Washington on Tuesday dismissed a wrongful death claim brought as part of a lawsuit against former President Donald Trump and two men accused of assaulting U.S. Capitol Police Officer Brian Sicknick during the Capitol riot.

U.S. District Judge Amit Mehta ruled that Sicknick’s longtime partner, Sandra Garza, lacked standing to bring such a claim against Trump and defendants Julian Khater and George Tanios because she was not Sicknick’s spouse and did not meet the legal definition of being his domestic partner.

“[Garza’s] contention that a ‘domestic partnership’ was established simply by Officer Sicknick having identified Garza as his ‘domestic partner’ in his will finds no basis in the plain text of the statute,” Mehta wrote. “Garza therefore cannot recover the damages she personally seeks under the Act.”

Mark S. Zaid, one of the attorneys representing Garza, said in a statement: “We are pleased to see that our lawsuit in pursuit of justice for the late Capitol Police Officer Brian Sicknick, who died in the aftermath of the January 6th insurrection, has been permitted to continue. We are now considering our next step options, to include deposing former President Trump.”

A federal judge on Tuesday dismissed most of the civil counts against former President Donald Trump and two others in connection with the death of Capitol Police Officer Brian Sicknick during the U.S. Capitol riots on Jan. 6.

In a 12-page ruling, U.S. District Judge Amit Mehta dismissed three of the five civil counts in a lawsuit filed last January by Sandra Garza, Sicknick’s girlfriend.

Garza’s lawsuit against Trump and Jan. 6 rioters Julian Khater and George Tanios sought damages from all three men for claims of wrongful death, conspiracy to violate civil rights, and negligence per se based on D.C.’s anti-riot law.

In his ruling Tuesday, Mehta dismissed the wrongful death act count and both negligence per se allegations.

If you ask me, this whole lawsuit is ridiculous and should be thrown out altogether.
