California School Reverses Pro-ICE Student’s Suspension After Civil Rights Complaint


Even in Gavin Newsom’s California, some efforts to restrict free speech can still go too far. That was apparently the case in one San Diego-area school, where a student was reportedly suspended for displaying a poster in support of Immigration and Customs Enforcement.

Importantly, the same school had previously allowed anti-ICE students to share their often profane sentiment in common areas of the school, but when this student shared a contrary opinion, it was labeled harassment.

The Daily Caller shared some of the details:

The school suspended the student over the flyers despite the fact they were posted in a common area where other political flyers had been posted previously. Still, the school claimed that the student engaged in “harassment” and “intimidation,” by posting the flyers.

“School administrators can’t pick and choose which opinions students are allowed to express,” said FIRE Supervising Senior Attorney Conor Fitzpatrick, via the Wednesday press release. “Voicing an opinion which makes others upset is not ‘harassment’ or ‘intimidation,’ it is American democracy in action.”

The school agreed to wipe out the suspension after the student secured representation from FIRE.

Across the country, students have walked out of school to protest ICE, especially since Department of Homeland Security (DHS) officers were involved in the fatal January shootings of Alex Pretti and Renee Good in Minneapolis. Other walkout protests have generated controversy or have turned violent.

A student at Torrey Pines High School in San Diego was suspended after posting a pro-Immigration and Customs Enforcement flyer reading, “We [heart] ICE – Real Americans,” following an anti-ICE walkout on campus, according to the Foundation for Individual Rights and Expression.

Student-led anti-ICE walkouts have continued to rise nationwide. In 2026 alone, more than 300 such walkouts and protests have taken place. Various organizations have led training programs within K–12 schools, and the National Education Association has provided $1.7 million in funding to a May Day 2026 training toolkit that includes anti-U.S. Immigration and Customs Enforcement messaging, according to an investigation by Defending Education.

A “Four Weeks of Power” training series is organized and led by Free the Future, the Alliance to Reclaim Our Schools, New York University’s Steinhardt Metro Center and the Midwest Academy.
