President Trump’s Deputy Associate Attorney General, Ed Martin, isn’t leaving any wiggle room on this.
James Comey is going to go to jail — either for telling the truth about his infamous Instagram post calling for the assassination of President Trump…
Or, if he lies about it, for perjuring himself when questioned about the incident.

Martin broke down the situation during a conversation on Benny Johnson’s show this morning.
If you’re just now hearing the news of Comey’s call for President Trump’s assassination, here’s a great short clip with an overview of the situation to bring you up to speed:
Regardless of Comey’s quick attempt at backtracking — removing the inflammatory post and feigning ignorance — Martin says he certainly knew what ’86’ing someone meant.
Here’s a clip shared by Benny Johnson of Ed Martin’s expert breakdown of the trouble Comey just created for himself:

Ed Martin’s take sounds logical and legally sound, as you would expect.
The audacity of Comey to openly call for the assassination of President Trump, and expect that somehow the Trump Administration is going to NOT NOTICE or allow him to get away with it is “a colossal misjudgment”, as Ed Martin stated.
Whether by perjury, or by admitting his crime, Ed Martin is convinced that James Comey is about to go to jail and meet justice for a change.
But as usual, Comey already has the mainstream media playing footsie with him.
If CNN’s reporting is to be believed, even if Comey did know what he was doing, there’s no use in attempting to prosecute him for it.
If you ask me, that sounds like SEEDING THE NARRATIVE in order to get ahead of the story.
The problem is, the political winds — AND THE WINDS OF JUSTICE — have shifted.
But here’s a good overview of mainstream media’s horrible attempt at trying to beg leniency for Comey, as reported by CNN:
The director of US intelligence voiced concern for President Donald Trump’s life after former FBI Director James Comey posted a picture of seashells writing out four numbers. The Secret Service is investigating. And the FBI is ready to provide support.
But the end result could be little more than a stern warning for Comey, who infamously oversaw the agency during two separate and fruitless investigations into Trump and Hillary Clinton during the 2016 presidential campaign.
ADVERTISEMENTLegally speaking, prosecuting Comey may be fruitless as any legal action would stand little chance, especially after a recent Supreme Court decision regarding threats and among a judiciary that has expanded free speech rights in recent years, legal experts say.
One source with knowledge of the Secret Service investigation told CNN that the investigation likely “ends” with Comey receiving a stern talking-to from law enforcement.
A Secret Service source familiar with the investigation told CNN that under normal circumstances, such a post wouldn’t warrant a full-fledged investigation but under the current political climate will likely get more attention. Such an investigation, the source said, would serve as a distraction for agents in an organization already stretched thin.
While perhaps not a chargeable offense, Comey’s post, however, was unadvised, according to a former Secret Service agent.
“It’s not a direct threat. It doesn’t say, ‘go out and kill Donald Trump.’ It doesn’t,” Jon Wackrow, a CNN analyst and former Secret Service agent said. “But in the context of our environment today, this imagery is extremely dangerous, and more so coming from somebody like Comey, who should know better.”
During the Biden Administration, or Obama’s term, I would agree.
There’s no way the former FBI Director — A DEMOCRAT — is going to face justice in a situation like this even if he’s guilty.
But those winds have certainly shifted, whether CNN wants to admit it or not.
And part of those shifting winds is simply having a President who is willing to call a spade a spade, which transfers to an entire Administration that deals in reality, and not just political optics.
Just as President Trump was willing to say what we’re all thinking in this interview with Fox News, so will be the rest of his team:

Tim Burchett, for example, may be known as a straight shooter; often willing to get played as being anti-Trump in order to stick by his principles.
But he’s also known as one of the nicest guys in Congress.
And that “nice guy”… posted THIS:
Arrest Comey.
— Tim Burchett (@timburchett) May 15, 2025
It isn’t looking good for old Comey.
And he isn’t the only one openly saying Comey should be in jail for his dangerous 8647 post.
Tulsi Gabbard, Kristi Noem, Kash Patel — they’re all on board with following this where it should lead: the arrest and prosecution of James Comey, according to Newsweek:
Director of National Intelligence Tulsi Gabbard has said that former FBI director James Comey should be jailed for posting a photo of shells that were aligned to read “8647.”
Speaking to Fox News, Gabbard said: “Any other person with the position of influence that he has, people who take very seriously what a guy of his stature, his experience and what the propaganda media has built him up to be, I’m very concerned for the president’s life.
“We’ve already seen assassination attempts. I’m very concerned for his life. And James Comey, in my view, should be held accountable and put behind bars for this.”
The number “86” generally means to “get rid of” something or someone, such as an item or a customer. However, it has more recently been used as a slang term for killing someone.
Homeland Security Secretary Kristi Noem said the DHS and the Secret Service are investigating the post.
FBI Director Kash Patel also said on X, formerly Twitter, that the agency was aware of the post and “will provide all necessary support.”
ADVERTISEMENTRepublican Tennessee Congressman Tim Burchett wrote on X: “Arrest Comey.”
It seems as though all the dominoes are lined up for Comey’s arrest.
One thing remains to be seen:
Does anyone actually believe Pam Bondi will hold James Comey accountable through the so-called "established legal process"? 🤷🏼♀️ pic.twitter.com/mv0tAJHY2I
— Desiree (@DesireeAmerica4) May 16, 2025
Yes, ultimately the question of whether to charge Comey will more than likely come down to Pam Bondi’s decision.
As several events have unfolded over the Trump Administration’s first 100 days that might call Bondi’s loyalty in to question, that seems like a legitimate question to be asking right about now.
That could turn out to be the million dollar question in regards to whether Comey slips through the hands of justice, or meets the consequences of his actions in this circumstance.
So, what’s it gonna be, Pam?
Justice… or something less?
We’re all waiting.
