Illinois prosecutors announced on Tuesday the St. Charles officers who shot dead a man wielding a chainsaw inside of a nursing home will not face any charges.
Officers from the St. Charles Police Department shot and killed Daniel H. Escalera after he wielded a chainsaw inside the River Glen of St. Charles assisted living facility on Dec. 1, 2024.
The Illinois state attorney’s office announced that the officers were cleared from wrongdoing due to their force being “necessary to prevent death or great bodily harm.”

Police officers who shot and killed a man who was wielding a chainsaw inside a seniors’ assisted living center in St. Charles, Illinois, in December will not face any criminal charges, Kane County prosecutors announced on Tuesday.
Daniel H. Escalera, of Stockwell, Indiana, was shot and killed by police at the River Glen of St. Charles assisted living facility on Dec. 1, 2024.
Kane County State’s Attorney Jamie Mosser’s office reviewed an Illinois State Police investigation of the shooting, and announced Tuesday that the shooting was justified, and none of the officers involved will face any criminal charges.
Body camera footage released by Mosser’s office shows St. Charles police officers confronting Escalera inside the lobby and cafeteria of the building.
The first officer who arrived on the scene pointed a Taser at Escalera as he is trying to start the chainsaw, and repeatedly telling him to drop it.

Police officers in suburban St. Charles will not be charged after a chainsaw-wielding man was fatally shot inside an assisted living home late last year.
According to the Kane County State’s Attorney’s Office, officers will not face charges in the shooting death of 41-year-old Daniel Escalera, who was killed inside of the River Glen of St. Charles facility on Dec. 1, 2024.
According to the state’s attorney’s office, the shooting was deemed “necessary to prevent death or great bodily harm,” and charges will not be filed in the case.
“I am very proud of how our Officers responded to this incident,” said St. Charles Acting Chief of Police Eric Majewski. “They were confronted with a fast-paced situation in which they attempted all means of de-escalation to protect the elderly residents and themselves that had been placed in immediate harm’s way.”
Officers were called to the facility on Dec. 1 after reports of a man trying to cut down a tree with a chainsaw. That man then tried entering the facility, an officer confronted him inside near the doorway to a cafeteria, where residents were dining.
