Johnson & Johnson has settled two lawsuits claiming its talc products have caused cancer.
Talc is a “naturally occurring mineral, mined from the earth, composed of magnesium, silicon, oxygen, and hydrogen.”
The settlements cases stem from Rosalino Reyes and Marlin Eagles who said they got mesothelioma cancer “related to asbestos in J&J talc powder.”
Details regarding the settlement have not been made to the public and have been kept privately.
In total J&J faces more than 50,000 lawsuits over its talc products, mostly by women diagnosed ovarian cancer.

Johnson & Johnson (JNJ.N) on Thursday said it has settled two lawsuits claiming its talc products caused cancer, the first such cases to go to trial since a federal court rejected the company’s plan to move its talc liabilities into bankruptcy court.
The settlements resolved lawsuits brought by two men, Rosalino Reyes and Marlin Eagles, who said they developed mesothelioma related to asbestos in J&J talc powder, and was part of a broader deal to settle all talc cases brought by the law firm representing them, Kazan, McClain, Satterley & Greenwood, the company said. Reyes’ family continued his lawsuit after he died in 2020.
The company faces more than 50,000 lawsuits over talc, most by women with ovarian cancer. It has said that its talc products are safe and do not contain asbestos.
J&J and the plaintiffs’ lawyers did not disclose any terms of the settlement, or how many cases it covered. Reyes’ trial had begun last week, while Eagles’ was about to begin, with a jury chosen.
“The Eagles and the Reyes families express thanks to the jurors and courtroom personnel who participated in the trial,” Joseph Satterley and Denyse Clancy, attorneys for the plaintiffs, said in a joint statement.

One attorney leading the fight against Johnson & Johnson (NYSE: JNJ) on behalf of 12,000 women and their families harmed or killed by the company’s talcum powder products, says J&J’s decision to settle two talcum powder trials in California undermines the company’s claim that bankruptcy is the only way to resolve more than 50,000 lawsuits.
Andy Birchfield, head of the Mass Torts Section at the Beasley Allen Law Firm, says the settlements have profound implications.
“Perhaps this is an indication that J&J is abandoning its ‘bankruptcy or bust’ strategy in favor of good faith settlement discussions. J&J’s twice-failed bankruptcy gambit has inflicted further harm to cancer victims who were long term baby powder users as well as had disastrous results for shareholders.”
According to Mr. Birchfield, the settlements also demonstrate that J&J is acknowledging its talc products contain asbestos.

Johnson & Johnson faces at least 18 jury trials over the next year tied to claims of tainted talc in its iconic baby powder, prompting the company to consider a third bankruptcy filing in hopes of fostering a global settlement.
J&J has talc cases set for trial everywhere from Pennsylvania to California between November and December 2024, some of which involve consolidated claims by more than a half-dozen plaintiffs, according to their lawyers. Those trials were scheduled after a judge in July threw out a J&J unit’s latest Chapter 11 case aimed at resolving all current and future talc claims.
Since 2016, J&J has been hit with at least $570 million in damage awards over talc-related cancer claims and paid out at least $2.5 billion in settlements, according to data compiled by Bloomberg.
“With all those trials staring them in the face, of course they want their unit to run back into bankruptcy,” said Carl Tobias, a University of Richmond professor who teaches about mass torts and has followed the talc cases. “They are playing for time and to avoid shelling out the hundreds of millions of dollars on lawyers to defend all those trials.”

The Looming Bankruptcy of J&J and Big Pharma’s Struggles in the Post-Covid Pandemic Emergency
Johnson & Johnson, the consumer health and Big Pharma giant, is on the brink of filing for bankruptcy.
J&J is currently facing more liability than cash reserves. It is potentially on the hook for an $8.9 billion settlement of tens of thousands of lawsuits that allege tainted talc in the company’s baby powder caused cancer and a host of other ailments.
The tort’s lawyers have gathered about 50,000 clients.
The massive lawsuit is ironic due to the number of Americans who claim to be injured by Covid-19 vaccines. These citizens predominately lack legal recourse due to the U.S. government’s provision of a liability shield for pharmaceutical manufacturers who produced the shots during the Covid pandemic.
However, the U.S. Health Resources and Services Administration (HRSA), which runs the Countermeasures Injury Compensation Program (CICP), recently issued the payments to two people who suffered heart inflammation after Covid-19 vaccination. One person received $4,183 and the other received $4,934. HRSA has declined to disclose which shots the people received.
The CDC in 2022 court filings disclosed to Texas-based nonprofit ICAN, the Informed Consent Action Network, that 7.7% — 782,913 people — out of the agency’s 10 million v-safe users reported adverse effects that led to medical attention via a telehealth appointment, urgent care clinic, emergency room intervention or hospitalization following a Covid-19 vaccine.
It should be noted that v-safe is a system that uses smartphones to send people text messages and web polls on a regular basis to keep an eye on any possible side effects from the Pfizer, Moderna, or Johnson & Johnson Covid-19 vaccines.
There is no way, unfortunately, based on the information the CDC collected, to determine whether the Covid-19 vaccines actually caused the ailments.
The federal government has temporarily paused using the third vaccine made by Johnson & Johnson.
Americans in general have slowed their uptake of “boosters” before the J&J vaccine was linked to rare but in some cases serious adverse effects. Less than 7% of the public has received the latest Covid “booster.”
Johnson & Johnson’s stock price is down 15% on the year, while Pfizer is down 40% and Moderna is down 54% over that time period.
A lack of legal recourse, public health misinformation issued during the pandemic (such as that mRNA vaccines stop the spread), and the predominance of some protection from natural immunity among the general population have led to increased ‘vaccine hesitancy’ and reduced demand, along with shrinking profits for Big Pharma manufacturers.

Johnson & Johnson said Tuesday it’s offering up to $8.9 billion to resolve lawsuits accusing the company of selling baby powder that caused cancer — an allegation that J&J has repeatedly denied.
Why it matters: J&J faces tens of thousands of lawsuits from people and their survivors related to the company’s talc-based powder.
Driving the news: J&J disclosed the offer Tuesday in connection with its decision to re-file its subsidiary LTL Management in Chapter 11 bankruptcy.
The Third Circuit Court of Appeals in January dismissed the original Chapter 11 petition made by LTL, the subsidiary J&J created for the purpose of housing its talc liabilities and filing for bankruptcy.
Details: The $8.9 billion in payments to alleged victims would be paid over 25 years “to resolve all the current and future talc claims,” J&J said in a statement.The company, which originally offered $2 billion, said it “has secured commitments from over 60,000 current claimants” to support the deal.
J&J noted that it is not admitting wrongdoing — but fighting the cases “would take decades and impose significant costs” with “most claimants never receiving any compensation,” said J&J’s worldwide vice president of litigation, Erik Haas.What they’re saying: Law firms representing what they described as a majority of the victims released a statement saying their clients are supporting the proposed deal.
“This settlement will provide expeditious, substantial and fair compensation to claimants who cannot afford to wait any longer for a resolution,” the victims’ representatives said Tuesday in a statement.
Makes me absolutely sick to think parents had no idea.

In new research, Consumer Reports tested a total of 126 products from stores like Walmart and Trader Joe’s and found that 40 “had high enough levels of arsenic, lead, and cadmium combined, on average, to pose a health concern for children when regularly consumed in typical serving sizes.” Beyond big-brand names like McCormick and private labels, the offenders also include spices and herbs from the beloved Wauwatosa, Wisconsin-based brand Penzeys.
It’s important to note that there is no safe amount of lead, especially for children. That’s because our bodies don’t have a way to digest heavy metals, so they can easily accumulate in the body, physically interfering with other processes. (Remember when Entourage’s Jeremy Piven blamed a public outburst on mercury poisoning because he’d been subsisting on only sushi?)
“In children, [lead] can affect brain development, increasing the risk for behavioral problems and lower IQ,” Consumer Reports explains in the report, published last month. “In adults, it can contribute to central nervous system problems, reproductive problems, and hypertension, and can damage kidney and immune function.”
Lead in foodstuffs is usually tested through a standard protocol laid out by the U.S. Food and Drug Administration (FDA), known colloquially as “EAM 4.7.” EAM stands for Elemental Analysis Manual for Food and Related Products. “This resource serves as a reference, for analysts at the FDA and around the world, providing not only general analytical information and procedures and detailed laboratory methods, but also helpful notes from analysts’ experiences using these methods,” the FDA explains online. In this testing, an acid chemically “digests” foods before they’re fed through a mass spectrometer machine that identifies the chemical signatures of different elements.
Which Herbs and Spices Contained High Levels of Lead?
Consumer Reports tested a total of 126 products across 38 brands, using two or three samples for each product. They ranked products from least to most concerning with the following system: no concern, some concern, moderate concern, and high concern. Here are the products that ranked as moderate or high concern:
- La Flor Ground Oregano
- La Flor Ground Turmeric
- Happy Belly (Amazon) Ground Thyme
- Spice Islands Sweet Basil
- Tone’s Ground Thyme
And from Consumer Reports:
Roughly one-third of the tested products, 40 in total, had high enough levels of arsenic, lead, and cadmium combined, on average, to pose a health concern for children when regularly consumed in typical serving sizes. Most raised concern for adults, too.
For two herbs, thyme and oregano, all the products we tested had levels that CR experts say are concerning.
In 31 products, levels of lead were so high that they exceeded the maximum amount anyone should have in a day, according to CR’s experts.
When people think about heavy metals in their diet it’s probably the lead in their drinking water. But our tests show that dried herbs and spices can be a surprising, and worrisome, source.
Also troubling: There was no single predictor of which products contained higher levels of heavy metals—for example, brand name didn’t matter, and neither did “organic” or “packed in USA” claims.
Now, as I promised….let’s talk solutions.
