Another state might be taking President Donald Trump off the ballot for 2024.
A now-debunked claim circulated on X (formerly Twitter) that Gavin Newsome wanted Donald Trump removed from the ballot.
The New Hampshire Secretary of State is considering removing President Trump from the ballot.
Now, tax attorney Lawrence Caplan has filed in federal court to remove President Trump from Florida’s ballot.

The claim is that President Trump shouldn’t be eligible to run because of the 14th Amendment.
Section 3 of the 14th Amendment reads as follows:
No person shall be a Senator or Representative in Congress, or elector of President and Vice President, or hold any office, civil or military, under the United States, or under any state, who, having previously taken an oath, as a member of Congress, or as an officer of the United States, or as a member of any state legislature, or as an executive or judicial officer of any state, to support the Constitution of the United States, shall have engaged in insurrection or rebellion against the same, or given aid or comfort to the enemies thereof. But Congress may by a vote of two-thirds of each House, remove such disability.

The 14th Amendment was passed in 1868 following the Civil War.
Former Confederate States elected federal representatives (to both the house and senate) who were political leaders during the war.
Section 3 eliminated them from holding office.
However, in 1872 the Amnesty Act was passed which allowed all but the most senior members of the Confederacy to be elected.
Section 3 was created to remove political power from those who engaged in active warfare against the United States government.
Can it possibly be applied to President Trump?
There is a disagreement amongst legal scholars.

With a court case now in the works, it may be up to the courts to decide.
To consider calling people to peacefully protest an “insurrection” seems like a stretch to me, but I am no legal expert.
President Trump is commanding such a strong lead in the polls his removal may be viewed as radical attack on Republican.
