U.S. Citizenship And Immigration Services Ends COVID-19 Jab Mandate For Legal Immigrants


U.S. Citizenship and Immigration Services (USCIS) has rescinded its COVID-19 jab mandate for legal immigrants.

“Effective January 22, 2025, USCIS waives any and all requirements that applicants for adjustment of status to that of a lawful permanent resident present documentation on their Form I-693, Report of Immigration Medical Examination and Vaccination Record, that they received the COVID-19 vaccination,” a statement read.

“USCIS will not issue any Request for Evidence (RFE) or Notice of Intent to Deny (NOID) related to proving a COVID-19 vaccination.  USCIS will not deny any adjustment of status application based on the applicant’s failure to present documentation that they received the COVID-19 vaccination,” it added.

“I have a bill to end the COVID jab mandate for legal immigrants, but Trump just suspended the mandate. Hallelujah!” Rep. Thomas Massie (R-KY) said.

“Promises made, promises kept. Thank you, @realDonaldTrump,” she added.

Gaines previously said her husband could not obtain a green card because of the COVID-19 jab requirement.

“Just got another letter from USCIS saying they won’t give my husband his green card until he gets the Covid jab. This is ridiculous. We’ve been married coming up on 3 years. We’ve spent thousands for the submitted forms to expire on their time,” she said.

On Monday, Gaines took to X, formerly Twitter, to share that her husband, who is from the United Kingdom, has been allegedly unable to get his green card due to his vaccination status.

“My husband moved to America from England for college 6 years ago. We got married over 2.5 years ago. He STILL doesn’t have a green card because he won’t get the vaccine. They don’t force illegal immigrants to get the jab, just the legal ones,” Gaines wrote.

U.S. immigration law requires those seeking a green card to meet certain vaccination requirements. Migrants who are in the country unlawfully are not bound by those same rules until they apply for a visa or citizenship.

According to the U.S. Citizenship and Immigration Services (USCIS), a noncitizen who applies for a visa abroad or “seeks to adjust status to that of a lawful permanent resident while in the United States” is required to get some vaccines, including COVID-19.

They are also required to take vaccines for mumps, measles, rubella, polio, tetanus and diphtheria toxoids, pertussis, Haemophilus influenza type B, hepatitis B, COVID-19, and any “other vaccine-preventable diseases recommended by the Advisory Committee for Immunization Practices.”
