The $5 million judgement against President Trump will stand — that is according to a federal court that ruled against his appeal earlier today.
A three-judge panel unanimously refused to accede to President Trump’s argument that comments he previously made on video were unrelated to the case and should not have been used to incriminate him in the rape case brought by E. Jean Carroll.
Here’s the breaking report put out by Fox News as soon as the appeals court ruling was handed down.
President Trump can continue to appeal the verdict.
As MJTruthUltra points out below, he has the option of taking his appeal all the way to the Supreme Court.

Trump can either appeal the ruling to the full bench of the Manhattan-based 2nd U.S. Circuit Court of Appeals or MORE LIKELY… to the Supreme Court.
As MJTruthUltra pointed out in his post on X, the opinion of the federal appeals court admits that there is no evidence he actually committed the crime E. Jean Carroll accused him of.
He also shared a video of President Trump from earlier in the case completely obliterating the “Carroll Hoax”, as he calls it.
In the video, he points out the odd fact that Law & Order is Carroll’s self-described favorite television show, and an almost identical case is presented on an episode of Law & Order matching her allegations against him.

Nevertheless, the appeals court upheld the multi-million dollar verdict.
The federal appeals court decision was unanimous, according to a report by Reuters:
A federal appeals court on Monday upheld a $5-million verdict that E. Jean Carroll won against Donald Trump when a jury found the U.S. president-elect liable for sexually abusing and later defaming the former magazine columnist.
A unanimous three-judge panel of the 2nd U.S. Circuit Court of Appeals in Manhattan rejected Trump’s argument that the trial judge should not have let jurors hear evidence about the Republican’s alleged past sexual misconduct, making the trial and verdict unfair.
The court said that evidence, including Trump bragging about his sexual prowess on an “Access Hollywood” video that surfaced during the 2016 U.S. presidential campaign, established a “repeated, idiosyncratic pattern of conduct” consistent with Carroll’s allegations.
“Taking the record as a whole and considering the strength of Ms. Carroll’s case, we are not persuaded that any claimed error or combination of errors in the district court’s evidentiary rulings affected Mr. Trump’s substantial rights,” the court said in an unsigned decision.
The May 2023 verdict stemmed from an incident around 1996 in a Bergdorf Goodman department store dressing room in Manhattan, where Carroll, now 81, said Trump raped her, and an October 2022 Truth Social post where Trump denied Carroll’s claim as a hoax.
This is the same E. Jean Carroll who told CNN’s Anderson Cooper that her encounter with President Trump “was not sexual”.
(Of course, the jury was not allowed to view this video during the trial.)
And then with enough awkwardness to make Anderson Cooper visibly squirm in his chair, she looked him in the eye and flirted with him after describing her “rape” allegations.

The ruling by the federal appeals judges included their assessment that President Trump hadn’t demonstrated that the district court had erred in the initial ruling, according to a report by NBC News:
Trump has denied the allegations and appealed the verdict, charging it was “grossly excessive” and saying it should be tossed out because of what he claimed were unfair rulings by the judge who presided over the nine-day trial.
A panel of the 2nd U.S. Circuit Court of Appeals disagreed.
“We conclude that Mr. Trump has not demonstrated that the district court erred in any of the challenged rulings. Further, he has not carried his burden to show that any claimed error or combination of claimed errors affected his substantial rights as required to warrant a new trial,” the judges’ ruling said.
Steven Cheung, a spokesperson for Trump, said in response to the ruling: “The American People have re-elected President Trump with an overwhelming mandate, and they demand an immediate end to the political weaponization of our justice system and a swift dismissal of all of the Witch Hunts, including the Democrat-funded Carroll Hoax, which will continue to be appealed.” (Emphasis Added.)

President Trump is currently appealing the second case brought against him by E. Jean Carroll, which resulted in an $83 million judgment for defamation after he commented on the first case.
It sounds certain judging by the comments by President Trump’s spokesman in the case that he will continue to appeal the judgments against him.
