President Trump Takes Legal Action Against Biden Administration


President Trump filed an amicus brief to “immediately” stop the Biden administration from selling unused border wall materials to private parties.

The legal move supports Missouri and Texas, which filed a motion earlier this week to hold a status conference and determine if the federal government breached a court’s permanent injunction.

“Missouri and Texas have now identified for this Court a seemingly flagrant attempt by the Biden Administration to evade this Court’s final judgment and permanent injunction,” the brief writes.

The brief cites “prevalent reports” about the DoD selling “unused border wall panels.”

“Thus, the record suggests—but, admittedly, is not perfectly clear—that DoD may have transferred the relevant border-wall materials to DHS as part of its transfer of barrier projects to DHS under the Biden Administration. If so, the current reports of ‘fire sales’ of such materials raise grave concerns that DHS is not acting in good faith to comply with the Court’s injunction to expend appropriated funds to construct border barriers,” it continues.

“If, as discussed above, the Biden Administration’s conduct constitutes an attempted end-run around this Court’s injunction and the Congressional policy that it enforces, that conduct is unlawful on a series of deeply troubling grounds,” it states.

“The Court should issue an order directing the Defendants to immediately stop any ongoing sale of border-barrier materials to private parties pending the Court’s review of Defendants’ conduct, and the Court should swiftly conduct a searching examination of the Government’s conduct, by formal discovery if necessary, to examine the Government’s compliance with the law, the Constitution, and the Court’s injunction,” the brief concludes.

The Daily Wire’s December 12 report found that the material was being hauled off by private contractors to an auction site, where bidding for entire segments of unconstructed wall started at just $5. Trump said at a press conference this week that the outgoing administration “is trying to sell it for five cents on the dollar knowing that we’re getting ready to put it up.”

Steven Cheung, Trump’s top spokesman, said Trump filed the brief because of the Biden administration’s “egregious history of violating the law.”

“Any attempt by Biden officials to obstruct President Trump’s plan to build the Border Wall is unlawful, unconstitutional, and possibly criminal, as our brief argues,” Cheung said. “The Biden Administration has an egregious history of violating the law, especially in its catastrophic open-border policy, so the courts should review their actions here with particular skepticism.”

“President Trump will not be deterred from Building the Wall, securing our border, and Making America Great Again,” he added.

The amicus brief, filed in the Southern District of Texas, is in reference to cases brought by Texas and Missouri against the Biden administration regarding the sale of wall material. It argues that Trump has made clear his “support for building a system of border barriers at the southwestern border” and that “building the border wall is the clear and emphatic policy of the incoming Trump Administration.”

“Weeks before Trump takes office, Biden is racing to auction off unused border wall materials. Video shows trucks hauling wall materials off the border to a government auction site, where a massive amount of wall is waiting to be sold,” The Daily Wire previously noted.

The Biden administration has been auctioning off border wall parts since at least 2023, with parts listed for sale on auction marketplaces, after it abruptly shut down most border wall construction in 2021.

Those auctions have continued, with border officials telling Fox that auctions now occur weekly and have been for some time. However, the practice made news last week, when The Daily Wire published video showing parts being transported and cited Border Patrol agents who said the goal was to clear them out before Christmas.

Trump’s amicus brief states that if officials in the Biden administration are “deliberately selling off border-wall materials at a major financial loss to the Government to obstruct the pro-wall policy of Congress and President Trump, such conduct likely constitutes a criminal act, such as a conspiracy to defraud the United States.”

“At the very least, the reported conduct raises troubling concerns of potentially criminal behavior,” the filing states.
