Here Comes The Lawfare: Philadelphia DA Sues Elon Musk


And, here we go…the lawfare begins.

Just over a week away from Election Day, Philadephia’s District Attorney Larry Kraser — who is backed by none other than George Soros — has just filed a lawsuit against Elon Musk.

Why?

Because of his $1 million lottery for registered voters in swing states who sign his online petition supporting the Constitution.

Krasner, a Democrat, is accusing Elon Musk of running an “illegal” lottery, despite the fact that his giveaway does not reward people for voting — only for signing his petition.

The district attorney of Philadelphia filed a lawsuit Monday to halt Elon Musk ‘s $1 million giveaways as part of his political organization’s effort boosting Donald Trump ‘s presidential campaign.

The suit by Democratic District Attorney Larry Krasner is the first legal action to be brought over the America PAC’s sweepstakes offering $1 million every day until Nov. 5 to a person in a battleground state who has signed a petition supporting the Constitution.

Krasner’s office said the lawsuit, coming just over a week before Election Day, doesn’t preclude potential criminal action.

“The Philadelphia District Attorney is charged with protecting the public from public nuisances and unfair trade practices, including illegal lotteries. The DA is also charged with protecting the public from interference with the integrity of elections,” Krasner’s office said in a statement published on its website.

A spokesperson for the billionaire tech mogul’s America PAC, emailed for comment on the lawsuit and asked if the cash awards would continue, responded with a link to an X post, which showed the latest $1 million winner holding an oversize check.

Before the lawsuit, election law experts raised questions that it violates federal law barring anyone from paying a person to vote or register to vote. The issue, they say, is that winning the award requires contestants to be registered to vote in one of a handful of battleground states. Musk has cast the money as both a prize as well as earnings for work as a spokesperson for the group.

The lawsuit from Philadelphia District Attorney Larry Krasner claims Musk and his America PAC are “running an illegal lottery in Philadelphia (as well as throughout Pennsylvania).” The filing claims Musk’s $1 million giveaway amounts to an “illegal lottery scheme” in the state — one they say is prohibited because lotteries in the state are required to be regulated by the commonwealth.

As such, Krasner is seeking an emergency injunction, saying Musk “must be stopped, immediately” over what they say is a “scheme to influence voters.”

Notably, the filing specifically states “this is not a case” about whether or not Musk violated state/federal laws that prohibit vote buying — as some experts have suggested — but rather one that revolves purely around illegal lotteries and “deceiving consumers.”

Musk announced the eighth winner of his super PAC’s $1 million prize in Lancaster, Pennsylvania, on Saturday and doubled down on his promise to continue offering the money to a registered swing state voter who has signed his petition. He said participants are not required to vote, but the online petition form says one has to be a registered voter to be eligible.
