According to an update uploaded by Gina Carano today on X, Disney’s attempt to squash her suite against them as well as the subsequent attempt to delay “all discovery” until they could appeal the denial of their initial dismissal request have all been denied.
Gina Carono’s wrongful termination and sexual discrimination lawsuits will move forward, and she will have her day in court. DISNEY… DENIED!

Yesterday, October 16th, 2024 we learned that the Judge DENIED Disney’s unusual request.
I am obviously very pleased with the opportunity to keep moving forward with the judicial process and into discovery.

While conservatives in Hollywood have begun speaking out more than in years past, the reality has proven that backlash by the left-dominated industry tends to put most conservative actors in a tough spot when speaking out about workplace injustices. According to an article on Deadline.com, things have taken a better turn in the case of Gina Carano, who will finally get to take her case to trial next in September of next year.
After having beaten the Mouse House and its Daniel Petrocelli-led legal team’s move earlier this year to get her Elon Musk-backed sex-discrimination and wrongful-dismissal suit tossed, Carano this week scored another winner, with a federal judge denying Disney’s desire for a stay of proceedings and interlocutory appeal.
“Having considered the parties’ submissions, the relevant law, and the record in this case, the Court DENIES the Motion,” U.S. District Judge Sherilyn Peace Garnett wrote earlier this week. In refusing to give the green light to Disney’s hopes of taking the matter to another court and overturning her July 24 decision rejecting their motion for dismissal, the ruling has set the clock ticking on the trial.
In fact, with her previous ruling being challenged by the very nature of Disney’s latest motion and desire for an appeal, Garnett made sure to knock down any notion Disney and its outside counsel may or may not have had of getting the upper hand.
“Defendants do not, however, explain how a Ninth Circuit opinion affirming the Court’s Order would alleviate the burden of responding to the discovery Plaintiff has propounded to date, nor is it apparent to the Court how such a decision could provide such relief,” Garnett writes in the 10-page order. “In any event, arguments regarding discovery — which, the Court notes, were not at issue in the Order — do not appear to have any bearing on the termination of the litigation and do not persuade the Court that certification is appropriate here.”
In other words: Don’t waste my time, we’re all adults here.
Don’t miss the fact that not only did the judge deny Disney’s initial push for a dismissal, and then deny their request to immediately appeal the judges dismissal of their dismissal request (stick with me…), but she then ruled in such a way — pinning down the court date, in particular — that she cut off any future anticipated moves by Disney in drawing out or attempting to have some other court agree to their requests.
Denied, and locked in to place; that’s what just happened to Disney.
The court battle stems from Carano’s assertion that her character on the Disney series “The Mandalorian” was written out of the script — and Carano fired — primarily because of her political views, according to a report on Bloomberglaw.com.
Gina Carano is a conservative who pushed back (openly… shame, shame!) against adding “woke” pronouns to her online bios, and for refusing to accept the concepts being pushed by the gender fluidity crowd.
Let me be clear — Carano simply refused to obey “woke” protocol, and exercised her first amendment rights of free speech in the public forum. And she was FIRED for it. Hence, the lawsuit. GOOD FOR HER!
The mixed martial artist turned actor sued the media giant earlier this year, alleging that her character was written off the show mainly because of her political views on issues ranging from gender identity, Covid-19, vaccines, and the 2020 election. Disney was unable to get the suit dismissed from the US District Court for the Central District of California. Elon Musk is financing the lawsuit.
Carano’s case may test the boundaries of California law, unique in protecting employees who are politically active outside their workplace from employer retaliation.
In July, Carano posted on X when the judge denied Disney’s initial request to throw the case out completely, and included this video message.

The video was a portion of an interview Carano had with Ben Shapiro about her story, highlighting the injustices often experienced by conservatives working in very left-dominated industries. At the time, she also thanked Elon Musk for allowing her an uncensored voice on his newly acquired Twitter — which was in the process of “transitioning” (pun intended) to X.
With the landscape in America littered with stories like hers, it is easy to get lost in the “big picture” and forget that individual lives are actually being ruined in many cases simply because the “woke mind virus” has proven even more virulent and dangerous than some other things I could compare it to. It’s good to see people standing up to the tyranny of this virus, as well — and starting to win, as a reward for their courage.
