MICHIGAN REVERSAL! Big Win for RFK Jr, President Trump – Nightmare Fuel for Democrats


In another BIG REVERSAL in the ongoing battle of the ballots, specifically whether RFK Jr’s name should be removed or remain, a Michigan appeals court has ruled against the MI Secretary of State, in favor of RFK Jr, handing the Trump Campaign a huge win!

Jocelyn Benson has made it her personal mission to keep RFK Jr’s name on the Michigan ballots, even while trying to get Carson West’s name removed (successfully at first, in a decision that was also ultimately reversed by the courts).

For a little detail into the ongoing drama, here’s what NBC is reporting:

In Michigan, an appeals court agreed to remove Kennedy from the ballot as well, disagreeing with Secretary of State Jocelyn Benson, a Democrat, that it was too late to remove him. Benson plans to appeal immediately, said Angela Benander, a spokesman for the secretary, as military and overseas ballots must go out soon.

As a third-party presidential candidate, Kennedy had fought to secure ballot access. But after he dropped out of the race and endorsed former President Donald Trump, he sought to remove himself as an option for voters, as polling indicates his presence on the ballot could hurt the Republican nominee.

As of the time of this writing, no appeal has been forthcoming from the democrats challenging RFK Jr’s right to remove his name from the ballot.  The ballots have not been printed in Michigan, leaving a window open for an appeal to reverse the decision — but the success of an appeal at this point doesn’t seem likely.  That said, stranger things have happened in this election year alone!

Just a few days ago a spat between Rudy Giuliani and Jocelyn Benson took shape around the question of RFK Jr’s name on the ballot, with the MI Secretary of State taking a swipe at Giuliani:

Personally, I can’t wait to see the response now, with the decision going completely in RFK Jr’s favor.  The decision from the appeals court was unanimous and completely unambiguous in ordering Kennedy’s name removed.  Here’s some current reporting from The Epoch Times with a little more detail on the decision:

A Michigan appeals court has sided with former independent presidential candidate Robert F. Kennedy Jr.’s request to have his name removed from the general election ballot, with the secretary of state’s office planning to appeal the decision to a higher court.

In a unanimous decision handed down on Sept. 6, the Michigan Court of Appeals ordered Kennedy’s name removed from the November ballot, overturning a lower court ruling that ordered him to remain on the ballot despite the fact that he has withdrawn from the race for the White House and endorsed former President Donald Trump.

The three-judge panel on the Michigan Court of Appeals found that Kennedy’s request for his name to be removed from the ballot was made close to the deadline for candidates to give notice to local officials, but not too late. The judges also found no statutory authority that would prohibit a candidate from withdrawing from the race, noting that it is Kennedy’s “clear legal right” to do so.

Is it just me, or is the court not only very clear that RFK Jr’s name should be removed, but… do I detect a little attitude?  “…removing plaintiff from the ballot is a ministerial task.”  Look — I’ll be the first to concede that it’s very easy to read too much into mere text, which does not allow the same ability to gauge the nuance of a person’s intention as if you were face to face, or even hearing audio.

Still… you’re going to tell me that wasn’t a push back against the ridiculous excuses that the likes of Jocelyn Benson have relied on to this point?

For the moment, it seems as though timing and legality are on RFK Jr’s side, and the ballots will likely be printed and distributed for use without his name.  But with democrats like Jocelyn Benson determined to do all they can to thwart President Trump’s re-election chances in November, even at the cost of an intentionally confusing ballot lineup, who knows what else we might see before the votes are finally tallied.
