Jack Smith’s Case Is In Trouble, Checkmate?


Jack Smith’s case may have just hit a major impediment—one so major it might see the entire case outright dismissed by Judge Aileen Cannon.

The concept of ‘Arbitrary enforcement’ has shaken up the case and given hope that justice might be served.

Smith’s case has now been colored by Special Counsel Robert Hur’s report and the decision not to charge Biden with any crime.

Judge Cannon has correctly pointed out that the state is enforcing the law only where it sees fit, they’re arbitrarily enforcing the law against people they don’t like. Journalist Julie Kelly explained:

“Robert Hur’s report and testimony is the biggest elephant in the room. The term “arbitrary enforcement” is used frequently by both the defense and Judge Aileen Cannon.

Cannon hammered the fact no former president or vice president has been charged under the Espionage Act for taking and keeping classified records including national defense information–which represents 32 counts against Trump in Jack Smith’s indictment.

Prediction: Cannon won’t dismiss the case based on the motions debated today–vagueness of the Espionage Act and protection under the Presidential Records Act.

But it’s very likely she will dismiss the case based on selective prosecution, a motion still pending before her.”

Julie Kelly went into further detail via her Substack:

Hur’s investigation determined that Zwonitzer, who wrote Biden’s book, “Promise Me, Dad,” deleted recordings of Biden that proved he knew he had classified files in his possession—tapes the ghostwriter destroyed after Hur’s appointment was announced.

The recordings, Hur concluded, had “significant evidentiary value.” Among the deleted audio files was a February 2017 interview when Biden told Zwonitzer he “just found all the classified stuff downstairs,” referring to top secret files related to the war in Afghanistan and a 2009 memo Biden wrote to President Obama about his opposition to troop surges in the region.

Liberals seethed at the idea of Judge Aileen Cannon granting motions favorable to the 45th President and his defense team.

Newsweek reminded readers of the bogus charges arrayed against former President Trump:

In a separate federal case, Smith last year charged Trump with conspiracy to defraud the United States, conspiracy to obstruct an official proceeding, obstruction of and attempt to obstruct an official proceeding, and conspiracy against rights in connection to the investigation.

The charges were over the riot at the U.S. Capitol on January 6, 2021, and the alleged plot to submit false slates of pro-Trump electors to the Electoral College.
