ONE MUST GO: Fulton County Judge Rules DA Fani Willis Or Special Prosecutor Nathan Wade Must Withdraw From Trump Case


Fulton County Superior Court Judge Scott McAfee has ruled Fulton County District Attorney Fani Willis can remain leading her racketeering indictment against Trump if special prosecutor Nathan Wade, whom she had a relationship with,  steps down from the case.

McAfee ruled, “As alleged, the claims presented a possible financial conflict of interest for the District Attorney.”

Judge McAfee’s ruling is a major disappointment to Trump’s legal counsel, considering they were aiming to dismiss Fulton County District Attorney Fani Willis from the case altogether.

Fulton County District Attorney Fani Willis is expected to remove Special Prosecutor Nathan Wade from the case immediately.

Fulton County District Attorney Fani Willis can remain leading her historic racketeering indictment of former President Donald Trump if special prosecutor Nathan Wade – with whom she had a romantic relationship – steps aside.

Fulton County Superior Court Judge Scott McAfee issued his ruling Friday morning in arguably one of the nation’s most anticipated legal and political decisions in decades.

Willis is the locally elected district attorney who issued dozens of indictments in August 2023 accusing the nation’s 45th president and his allies of trying to overturn Georgia’s 2020 election results.

But Willis has been facing allegations she misused taxpayer funds and crossed ethical boundaries during her romantic relationship with Wade.

“As alleged, the claims presented a possible financial conflict of interest for the District Attorney,” McAfee’s March 15, 2023, order said. “More importantly, the defense motions and the State’s response created a conflict in the evidence that could only be resolved through an evidentiary hearing, and one that could not simply be ignored without endangering a criminally accused’s constitutional right to procedural due process.

Fulton County District Attorney Fani Willis can stay on and prosecute the Georgia 2020 election interference racketeering case against former President Donald Trump and 14 of his co-defendants, Judge Scott McAfee ruled Friday, but only if she removes the special prosecutor with whom she engaged in a romantic relationship.

CNN has reached out to the district attorney’s office regarding the next steps in the case.

After more than two months marked by a flurry of court motions and hearings, which included fiery testimony from Willis on the stand defending her relationship with Nathan Wade, the sprawling conspiracy case against Trump and his 2020 allies can now proceed – depending on Willis’ decision.

Though the ruling helps bring to a close a contentious two-month detour that dragged the election subversion case into the romantic lives of the prosecutors, it nonetheless leaves a stain on one of the four prosecution teams pursuing charges against the former president.
