The appointment of Jack Smith occurred under dubious circumstances, to say the very least.
According to President Trump’s legal team, Smith made quite the stunning admission in his own court filing when he revealed that he is, ultimately, still under the discretion and supervision of the Attorney General.
This means that Smith is essentially under the supervision, and the behest, of the Executive Branch of government—he is not an independent prosecutor.
Smith is taking marching orders from Merrick Garland and Biden to interfere in an election where they are the incumbents.
How in the world is that seen as even remotely fair and balanced? It clearly isn’t. Previously, Rep. Anna Paulina Luna called on Smith to provide answers:
“My colleagues and I have grave constitutional concerns about the appointment of Jack Smith. That is why I am demanding answers from him. Jack Smith has 9 days to respond.”

Jack Smith's appointment as Special Counsel is Illegal and Unconstitutional. Therefore his cases against Donald Trump are Null and Void. That makes Merrick Garland a criminal. pic.twitter.com/wGp8UL8iTl

The Epoch Times provided this statement from President Trump on the targeted prosecution by Biden, Garland, and Smith:
“While Crooked Joe Biden and his Cronies have claimed from the outset they have nothing to do with Jack Smith’s Election Interference case against me, Smith himself admitted in a Court Filing yesterday that he ’remains subject to Attorney General direction and supervision,’ and that includes Biden.
Garland is carrying out the orders from his boss to prosecute me, and to interfere in the 2024 Election.
No sitting President has ever abused the Power of his Office so blatantly to pursue his Political Opponent in an Election year.”
Rep. Matt Gaetz also demanded answers on Jack Smith’s investigation from the Department of Justice Inspector General:
“Today I’m demanding the DOJ Inspector General Horowitz to investigate the election interference against President Donald J. Trump by Special Counsel Jack Smith.
The witch hunt against President Trump by Attorney General Garland and Special Counsel Smith is a partisan exercise, and the American people know it!
Jack Smith’s attempt to speed up the trial against President Trump violates the DOJ’s rules and the law.
His public comments and his office’s briefs before the Supreme Court demonstrate that he has no reason for his actions other than to unlawfully interfere in the 2024 presidential election.”

Newsmax had more on Rep. Matt Gaetz’s complaint against Smith:
Rep. Matt Gaetz, R-Fla., on Wednesday filed a complaint with the U.S. Department of Justice Office of the Inspector General, accusing special counsel Jack Smith of election interference for pressing the Supreme Court to fast-track consideration of former President Donald Trump’s immunity claim.
