ACLU Sides With Trump – Gag Order Is Unconstitutional


In a surprising turn, the ACLU has sided with President Trump.

The ACLU believes that Judge Chutkan’s gag order in the 2020 election case is unconstitutional.

This comes just as President Trump was issued a $10,000 fine for breaking the gag order in the New York indictment.

Judge Chutkan recently paused the gag order to respond to President Trump’s appeal to have the gag order dropped.

For four years during former President Donald Trump’s presidency, the American Civil Liberties Union was one of his biggest courtroom adversaries. Now, the group is taking his side in a high-profile fight over what Trump can say as a criminal defendant.

The ACLU on Wednesday stepped into the battle over Trump’s federal gag order, arguing that U.S. District Judge Tanya Chutkan violated Trump’s First Amendment rights as well as the public’s right to hear him when she issued the order earlier this month. Chutkan is presiding over the criminal case special counsel Jack Smith is pursuing against Trump for trying to overturn the 2020 presidential election results.

“The obvious and unprecedented public interest in this prosecution, as well as the widespread political speech that it has generated and will continue to generate, only underscores the need to apply the most stringent First Amendment standard to a restraint on Defendant’s speech rights,” ACLU attorneys wrote in a friend-of-the-court brief.

The group urged Chutkan to reevaluate her order, calling it both vague and overbroad, with aspects of its meaning “unknown and perhaps unknowable.” One particular uncertainty the ACLU seized on was the meaning of Chutkan’s prohibition on statements that “target” Smith, his prosecutors, court personnel, defense attorneys or witnesses.

These gag orders are so outrageous that even the ACLU is forced to admit they are unconstitutional.

Who would’ve figured that the Obama-appointed Judge acts outside the Constitution?

Aside from the hilariously biased speech against President Trump.

The ACLU is making the right call in backing President Trump.

The ACLU team acknowledged a “serious risk” that Trump could inspire his political supporters to violence. But their court filing said the First Amendment doesn’t give the judge license to gag him.

“The mere fact that others have threatened actions against trial participants after hearing Defendant’s words is not enough,” the ACLU said.

At a court hearing earlier this month, prosecutor Molly Gaston reminded Judge Chutkan that a Texas woman had been arrested for issuing violent threats against the judge. Trump also has been fined $5,000 in a civil fraud case in New York for failing to remove a baseless post attacking a judge’s law clerk from his campaign website.

Trump lawyers John Lauro and Todd Blanche call the gag order in D.C. an “unconstitutional prior restraint” and have launched an appeal, which could help to delay the trial scheduled for March 2024. The judge has issued a temporary pause on the gag order while she awaits additional legal filings.

As the days go on, these indictments and trials against President Trump have less and less backing.

An average Judge would drop the case, but of course, this is all part of their plan to prevent President Trump from winning the 2024 election.

Well, it’s not working!

Support for President Trump continues to skyrocket with each phony indictment that Democrats throw his way.
