Special Counsel Jack Smith is preparing a new case to charge President Trump once again.
In a new 22 page filing, Smith’s office has responded to Trump’s previous opposition to his proposed gag order.
Smith’s office filing claimed Trump’s recent public statements on Truth Social about prosecutors and other witnesses in his January 6th case warrant a gag order.
Also tucked in the filing, is a claim that Trump violated a federal law that prohibits people under a felony indictment to purchase a firearm.
The filing reads “When Trump was visiting a firearms dealer in South Carolina — he was caught potentially violating his conditions of release” by saying he was going to buy a Glock.”

Smith’s allegations do not represent the Trump campaign’s side of the story because Trump’s team put out a statement after he took photos with the gun dealer that he did not buy a gun.

Special Counsel Jack Smith’s office filed a reply Friday evening to former President Trump’s opposition to the prosecution’s proposed gag order in Trump’s federal election interference case.
Smith’s office raises new concerns about Trump’s recent public statements attacking prosecutors and other potential witnesses and also suggests he may have violated a law prohibiting people under felony indictment from purchasing firearms.
“Since [the] date [the government proposed the gag order], the defendant has continued to make statements that pose a substantial likelihood of material prejudice to this case and that fall within the narrowly tailored order proposed by the Government,” Smith’s office writes.The filing specifically flags to DC district judge Tanya Chutkan in a footnote that earlier this week when Trump was visiting a firearms dealer in South Carolina — he was “caught potentially violating his conditions of release” by saying he was going to buy a Glock and posing with it.
They say despite a statement from Trump’s spokesperson that later sought to clarify he did not actually purchase the firearm, Trump later re-posted a video from one of his followers with a caption stating he did buy the gun.

Special counsel Jack Smith’s office cited Trump’s social media post — where he attacked Gen. Mark Milley and suggested he should be put to death for treason — as fuel to bolster their push to put a gag order on the former president ahead of his Jan. 6 case.
Earlier this month, Smith’s team filed a motion for a partial gag-order on Trump’s public statements to bar him from attacking prosecutors, witnesses and others in ways that would threaten the integrity of the election meddling trial.
ADVERTISEMENTIn a Truth Social post last week, Trump accused Milley, the retiring chairman of the Joint Chiefs of Staff, of conspiring with China against his presidency. “This is an act so egregious that, in times gone by, the punishment would have been DEATH!” wrote Trump in the post.
In a 22-page filing Friday evening, prosecutors pressed on the need for a gag order on Trump’s behavior and rejected the former president’s claims that the motion was an attempt to silence him on the campaign trial. Instead, senior assistant special counsel Molly Gaston stated the order would prevent Trump from using “his candidacy as a cover for making prejudicial public statements about this case.”
Trump in the video said he would want to buy the gun he was being presented but never went through with the purchase.
