BREAKING: Illinois Supreme Court Deems Assault Weapon Ban Constitutional


The Illinois Supreme Court has ruled an assault weapon ban as constitutional.

The assault weapon ban passed following the Highland Park shooting.

A tragic event but enough to infringe on the 2nd amendment rights of Americans?

These events highlight why Americans NEED to be armed.

ABC News has more on the story:

The Illinois State Supreme Court found a strict assault weapons ban passed after the Highland Park shooting to be constitutional in a ruling issued Friday.

The ruling came in response to a lawsuit that claimed that the ban violated the equal protections clause of the 14th Amendment to the U.S. Constitution. The court reversed a lower court finding and said that the law does not violate the equal protections clause. However, the Supreme Court did not comment on claims that the law also violated the Second Amendment.

In the ruling, which was 4-3, Justice Elizabeth Rochford wrote, “First, we hold that the exemptions neither deny equal protection nor constitute special legislation because plaintiffs have not sufficiently alleged that they are similarly situated to and treated differently from the exempt classes. Second, plaintiffs expressly waived in the circuit court any independent claim that the restrictions impermissibly infringe the second amendment. Third, plaintiffs’ failure to cross-appeal is a jurisdictional bar to renewing their three-readings claim.”

She concluded, “Accordingly, we reverse the circuit court and enter judgment for defendants on the equal protection and special legislation claims.”

The law at the center of the suit prohibits assault weapons, assault weapon attachments, .50-caliber rifles or .50-caliber cartridges — the type of semi-automatic weapons used in many mass shootings around the country. It prohibits the purchase, sale, manufacture, delivery and import of these firearms. It gives exemptions to law enforcement, military, corrections and trained private security.

I find it odd that the judges did not consider whether the law violated the second amendment.

Maybe because they KNEW that it clearly violates it.

Gun laws are always going to be a slippery slope.

Where does it stop?

First, they ban attachments, then larger caliber rifles, and it just goes on and on.

Some folks in Illinois might view this as a win.

But the future will prove them wrong.

Let’s take a look over at The New York Times for more info:

From the beginning, the gun ban prompted challenges from Republicans, especially in conservative counties in Downstate Illinois, where some sheriffs have said that they will not fully enforce the new law.

Illinois has some of the strictest gun restrictions in the country, but state-by-state firearms laws have their limits. Officials in Chicago have long pointed to neighboring Indiana, with its looser gun laws, as the source of illegally obtained guns that are used in shootings in Chicago.

Opponents of the Illinois law have also pointed to a U.S. Supreme Court decision in a New York case last year as evidence that wide-ranging gun bans in Illinois will not withstand scrutiny.

In that case, New York State Rifle & Pistol Association v. Bruen, the high court found that Americans had a broad right to arm themselves in public and struck down a New York law that placed strict limits on carrying guns outside the home.

Democrats are going to keep pushing gun laws.

They want to disarm the American populace and leave them weak.

Do you think that criminals are going to abide by these laws?

Of course not!

They will get their hands on weapons while you’re left defenseless.

This is their plan, and it will keep happening unless they are kept out of office.
