One of Charges in 4-Count Trump Indictment Includes Potential Death Penalty


A federal grand jury indicted President Trump Tuesday regarding Special Counsel Jack Smith’s probe into the (federally-staged, sham) January 6th debacle.

BREAKING: Brand New 4-Count Trump Indictment!

Trump has been indicted on four federal counts.

  • Conspiracy to defraud the US
  • Conspiracy to Obstruct an Official Proceeding
  • Obstruction of and Attempt to Obstruct an Official Proceeding
  • Conspiracy against Rights

One charge, “Conspiracy Against Rights,” includes a penalty of up to 10 years in federal prison.

However, it adds that “if death results from the acts committed in violation…the offender “may be sentenced to death.”

18 U.S. Code § 241 – Conspiracy against rights reads:

ADVERTISEMENT

If two or more persons conspire to injure, oppress, threaten, or intimidate any person in any State, Territory, Commonwealth, Possession, or District in the free exercise or enjoyment of any right or privilege secured to him by the Constitution or laws of the United States, or because of his having so exercised the same; or

If two or more persons go in disguise on the highway, or on the premises of another, with intent to prevent or hinder his free exercise or enjoyment of any right or privilege so secured—

They shall be fined under this title or imprisoned not more than ten years, or both; and if death results from the acts committed in violation of this section or if such acts include kidnapping or an attempt to kidnap, aggravated sexual abuse or an attempt to commit aggravated sexual abuse, or an attempt to kill, they shall be fined under this title or imprisoned for any term of years or for life, or both, or may be sentenced to death.

Breitbart reports:

One person — Ashli Babbitt, a rioter shot by a law enforcement officer — died as a result of the Capitol riot on January 6, which Smith said Tuesday was the result of Trump’s claims about the election. But Democrats have blamed Trump for the unrelated deaths of several protesters and Capitol Police officers.

Democrats — and some of Trump’s Republican opponents — have also tried to blame him for apparent efforts by some of the rioters to kidnap then-Vice President Mike Pence, Speaker of the House Nancy Pelosi (D-CA). Smith could try to argue the same.

The other counts in the witch hunt indictment also contain lengthy prison sentences.

Trump was hit with four serious felonies in the new indictment, accusing him of fraudulently trying to undo his loss in the 2020 election.

The first charge, conspiracy to defraud the United States, has a maximum possible sentence of five years in prison if convicted.

Two other charges — conspiracy to obstruct an official proceeding, and obstruction of an official proceeding — carry much heavier maximums: 20 years in prison.

The fourth charge against Trump, conspiracy against rights, has a maximum possible sentence of 10 years behind bars.
